1. Acceptance of Terms

By downloading, installing, accessing, or using the Emoji mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and JG Applications Ltd, a company incorporated under the laws of England and Wales ("Company", "we", "us", or "our").

2. Description of Service

The Emoji App is a mobile application that uses artificial intelligence technology to convert selfie photographs into personalized emoji icons. The App operates on a subscription-based model and provides users with custom emoji keyboards for use across various messaging platforms.

3. Subscription Terms

The App operates on a subscription basis. By subscribing, you agree to pay the applicable subscription fees in advance. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.

All subscription fees are non-refundable except as required by applicable law. Subscription management is handled through the Apple App Store, and cancellations must be made through your App Store account settings.

4. User Responsibilities

You are solely responsible for:

Ensuring you have the right to use any photographs you upload to the App
Complying with all applicable laws and regulations when using the App
Maintaining the confidentiality of your account credentials
All activities that occur under your account
Ensuring your device meets the minimum system requirements

5. Prohibited Uses

You agree not to:

Use the App for any unlawful purpose or in violation of these Terms
Upload content that is offensive, harmful, or infringes third-party rights
Attempt to reverse engineer, decompile, or modify the App
Use the App to create content that violates platform guidelines
Circumvent any security measures or access restrictions
Use automated systems to access the App

6. Intellectual Property

The App and all related intellectual property rights are owned by JG Applications Ltd. You are granted a limited, non-exclusive, non-transferable licence to use the App solely for personal, non-commercial purposes.

You retain ownership of photographs you upload, but grant us a licence to process them solely for the purpose of providing the emoji creation service.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, JG APPLICATIONS LTD SHALL NOT BE LIABLE FOR:

ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
ANY LOSS OF PROFITS, REVENUE, DATA, OR USE
ANY DAMAGES ARISING FROM YOUR USE OR INABILITY TO USE THE APP
ANY DAMAGES RESULTING FROM UNAUTHORIZED ACCESS TO YOUR ACCOUNT
ANY DAMAGES ARISING FROM THIRD-PARTY CONTENT OR SERVICES

OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SUBSCRIPTION IN THE 12 MONTHS PRECEDING THE CLAIM.

8. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

9. Indemnification

You agree to indemnify and hold harmless JG Applications Ltd from any claims, damages, losses, or expenses arising from your use of the App, violation of these Terms, or infringement of third-party rights.

10. Termination

We may terminate or suspend your access to the App at any time, without notice, for any reason, including violation of these Terms. Upon termination, your right to use the App ceases immediately.

You may terminate your subscription through your App Store account settings. Termination does not entitle you to a refund of prepaid subscription fees.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting. Your continued use of the App constitutes acceptance of modified Terms.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

14. Entire Agreement

These Terms constitute the entire agreement between you and JG Applications Ltd regarding the App and supersede all prior agreements and understandings.

15. Company Information

JG Applications Ltd is a company incorporated under the laws of England and Wales. These Terms are effective as of the date last updated above.
