LICENSED APPLICATION END USER LICENSE AGREEMENT (EULA)
for Xzibit.ai

1. Scope of License
Xzibit B.V. (“Licensor”) grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Xzibit App (“Licensed Application”) on devices you own or control, including interaction with objects via QR Codes, NFC Tags, Beacons, or other activation methods.
You may use the Licensed Application solely for your personal, educational, or professional purposes in accordance with this Agreement.
You may not:
- Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the app.
- Reuse, republish, or remix any AI-generated content for commercial purposes without prior written consent.
- Resell, sublicense, or otherwise exploit any part of the Licensed Application or its content.
- Copy, share, or distribute content from the app for commercial use without explicit written permission.
2. Consent to Use of Data
By using the Xzibit App, you agree that Xzibit B.V. may collect technical and interaction data, including (where permitted):
- Device information (e.g. device model, OS version)
- IP address, browser type
- Scanned object IDs, location metadata (if you grant permission), interaction timestampsAny personally identifiable information (such as your email, device ID, or voice recordings, if applicable) will be processed only in accordance with our Privacy Policy (https://xzibit.ai/privacy-policy/).
No personal data will be collected or used without your explicit consent, unless required by law.
3. Beta Disclaimer
This is a beta version of the Licensed Application, provided for testing and feedback purposes only.
Features, performance, and availability may change or be discontinued at any time, without notice.
No guarantees are provided regarding uptime, availability, support, or performance during the beta phase.
4. AI-Generated Content Disclaimer
The Licensed Application uses AI models to automatically generate voice and text content.
Xzibit B.V. does not guarantee the accuracy, completeness, or reliability of any AI-generated content, and disclaims all liability for decisions or actions taken based on such content.
You are solely responsible for interpreting and using any information provided by the app.
5. Feedback
Any suggestions, feedback, bug reports, or ideas you submit via the app or support channels may be freely used by Xzibit B.V. to improve or enhance the Licensed Application, without any compensation or obligation to you.
6. External Services
The app may connect to third-party services (e.g. text-to-speech/audio providers, beacon middleware, navigation, booking or payment platforms).
Use of these services is at your own risk.
Xzibit B.V. is not responsible or liable for:
- The availability, accuracy, or safety of any third-party services,
- Any damages or losses resulting from use or misuse of such services.
You agree to comply with all applicable third-party terms and conditions.
7. Termination
This Agreement remains in effect until terminated by either party.
You may terminate by deleting the app and ceasing use of all features.
We may terminate at any time if you breach these terms, if required by law, or if the app is discontinued.
Upon termination, you must delete all copies of the Licensed Application in your possession.
8. No Warranty
THE LICENSED APPLICATION IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, XZIBIT B.V. DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AVAILABILITY, AND NON-INFRINGEMENT.
9. Limitation of Liability
To the fullest extent permitted by law, Xzibit B.V. shall not be liable for any indirect, incidental, or consequential damages (including lost profits, business interruption, or data loss).
Total liability for any claim shall not exceed €50 EUR, except as required by mandatory local law.
10. Export Compliance
You agree not to export or re-export the app or any related technology to any jurisdiction or entity prohibited by EU, UN, or US law.
By using the app, you confirm you are not subject to any such restrictions.
11. Government Use
Use by government entities is permitted only under the terms of this EULA.
The Licensed Application and documentation are considered “Commercial Items” as defined by applicable procurement law.
12. Governing Law and Jurisdiction
This EULA is governed by the laws of The Netherlands, excluding conflict of laws principles.
All disputes shall be subject to the exclusive jurisdiction of the courts of Amsterdam, unless mandatory law in your country grants you additional rights.EU Consumers: You may bring claims in your local court under your national consumer protection laws.
13. Updates to this Agreement
Xzibit B.V. may update or modify this EULA at any time.
Continued use of the Licensed Application after changes become effective constitutes acceptance of the updated terms.
Significant changes will be notified via the app or by email, where possible.
