Privacy Policy

1. Scope

This Privacy Policy explains how JetMAX collects, uses, stores, shares, and protects information when you access or use the Platform in the United States. Other countries may have separate privacy notices.

2. How Mileage Tracking Works

When you enable Mileage Tracking and grant the required permissions, JetMAX can run in the background of your device to help detect drives based on movement and activity signals — so you typically do not need to press a start or stop button for each trip.

You can classify drives (for example, as business or personal), add notes, parking and toll expenses, name locations, manage vehicles, and create reports to share for taxes, employer reimbursement, or personal records. You can pause or turn off Mileage Tracking, revoke permissions, or delete trip data at any time as described below.

If you do not want drive data collected, do not enable Mileage Tracking, keep it turned off, revoke location / activity permissions, sign out where applicable, or uninstall the app.

3. Information We Collect

Depending on how you use the Platform, we may collect the following categories of information:

We may also collect de-identified or aggregated information that is not reasonably linkable to you on its own (for example, device type or usage patterns). We do not knowingly collect Personal Information from children under 13.

4. How We Collect Information

We collect information when you:

5. How We Use Information

We may use collected information to:

We will not collect additional categories of Personal Information or use Personal Information for materially different, unrelated, or incompatible purposes without providing notice.

6. Location Information — Consent, Background Collection, and Control

By enabling Mileage Tracking and granting location permissions (including “Allow all the time” / background location where required), you affirmatively consent to our collection, use, disclosure, and storage of your location information as described in this Privacy Policy.

If you consent and do not later stop collection, we will continue collecting location information as needed to operate Mileage Tracking. If you later revoke consent or permissions and later re-enable them, collection may resume.

You may revoke consent at any time by turning off Mileage Tracking in the app, changing location or activity permissions in your device settings, contacting us, and/or uninstalling the app. If you revoke consent or delete your account, we may retain certain information as required by law or for legitimate business purposes (for example, fraud prevention, legal compliance, or backups for a limited period).

Mileage Tracking is intended to collect your location information for your use. You may not use the Services to collect another individual’s location information.

We take reasonable measures to protect location information from loss, theft, misuse, and unauthorized access, disclosure, alteration, or destruction. No method of transmission or storage is 100% secure.

7. How We Share Information

We may share information in the following circumstances:

We do not sell your Personal Information. We do not rent or lease Personal Information to unrelated third parties for their independent marketing.

8. Analytics, Aggregated Data, and De-Identified Information

We may use aggregated, anonymized, or de-identified information for analytics, research, product development, service improvement, and other lawful business purposes. Such information is not intended to identify you personally.

9. Data Retention

We retain Personal Information for as long as reasonably necessary to provide the Services, fulfill the purposes described in this Privacy Policy, comply with legal obligations, resolve disputes, enforce agreements, and protect our legitimate business interests.

Drive and mileage data may be retained while your account remains active and thereafter for as long as reasonably necessary for the purposes above (including ordinary business continuity and responding to User queries), unless you delete the data sooner or applicable law requires a different period.

When retention is no longer reasonably necessary, we will delete, anonymize, or de-identify the information, unless a longer retention period is required or permitted by law.

10. Data Security

We use reasonable administrative, technical, and organizational safeguards designed to protect Personal Information against unauthorized access, disclosure, alteration, loss, or destruction. However, no method of transmission over the Internet or method of electronic storage is completely secure, and we cannot guarantee absolute security.

11. Your Choices

12. U.S. State Privacy Rights (Including California)

Depending on where you live, you may have privacy rights under applicable U.S. state law, which may include the right to request access to, correction of, deletion of, or a portable copy of certain Personal Information; the right to know categories of Personal Information collected and disclosed; the right to opt out of “sale” or “sharing” of Personal Information if applicable; the right to limit use of sensitive Personal Information where required; and the right to appeal a denial of your request where required by law.

Categories of Personal Information we may collect in connection with the Services include identifiers; commercial information; internet or other electronic network activity information; geolocation data; and inferences or preferences you provide (for example, trip classifications). We collect these categories to provide and improve the Services as described above. We do not sell Personal Information as that term is commonly understood.

To submit a privacy request, contact [email protected]. We may need to verify your identity before processing your request. Only you (or an authorized agent, where permitted) may make a request related to your Personal Information. We will not unlawfully discriminate against you for exercising privacy rights available under applicable law.

13. Deletion Requests

You may request deletion of your Personal Information by contacting [email protected], or by using in-app account deletion / data controls where available. We may retain certain information as required or permitted by law, including for legal compliance, fraud prevention, dispute resolution, recordkeeping, or enforcement of our agreements.

14. Children's Privacy

JetMAX is not directed to children under 13, and we do not knowingly collect Personal Information from children under 13. If you believe a child under 13 has provided Personal Information to us, please contact us so we can review and delete the information where appropriate.

15. International Data Transfers

Your information may be transferred to and processed in countries other than the country in which you reside, including countries where we or our service providers operate. These countries may have data protection laws that differ from those of your jurisdiction. By using the Platform, you understand that your information may be transferred and processed accordingly, subject to applicable law.

16. Changes to this Privacy Policy

We may update this Privacy Policy from time to time. When we do, we will update the “Last Updated” date above and, where required by law, provide additional notice (for example, in the app or by email). If we make significant changes that affect your rights, we will provide advance notice where required.

Your continued use of the Platform after an update becomes effective means you accept the revised Privacy Policy.

Terms of Use

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use JetMAX. By using the Platform, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into these Terms.

2. Account Registration and Security

You may need to create an account to use some features. You agree to provide accurate, current, and complete information and to keep it updated.

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us promptly if you believe your account has been compromised.

3. JetMAX Services

JetMAX is a technology platform that provides tools and services intended to help gig economy workers and other drivers manage aspects of their activities, finances, planning, mileage, and professional development.

JetMAX acts solely as a technology provider. JetMAX does not employ Users, does not act as their agent, and does not create any employment, joint venture, partnership, franchise, or similar relationship with Users.

We may modify, suspend, limit, or discontinue any part of the Platform or Services at any time, with or without notice, to the fullest extent permitted by law.

4. Mileage Tracking Feature

Mileage Tracking is an optional feature that can automatically track miles using your device’s location and activity data to help you create and manage a mileage log. You may use your mileage log to organize, categorize, classify, report, and manage potentially reimbursable or deductible miles.

By enabling Mileage Tracking or using related features, you consent to collection and use of location and activity information as described in the Privacy Policy. Certain features may ask you to opt in to notifications or summaries; you may opt out in settings where available.

Not tax, legal, or accounting advice. Deduction estimates, IRS standard mileage rates displayed in the app, reports, and similar figures are provided for convenience only. Tax rules change, eligibility varies, and JetMAX does not guarantee that any amount is deductible, reimbursable, or accepted by the IRS, an employer, or any other party. You are solely responsible for verifying rates, maintaining adequate records, and obtaining advice from a qualified professional.

Accuracy. Trip detection, distances, routes, addresses, and estimates depend on device sensors, permissions, network conditions, maps/geocoding providers, and other factors outside our full control. We do not warrant that mileage logs will be complete, uninterrupted, or free of errors or omissions.

Safety. You acknowledge that you will only use the Services when it is safe to do so. Do not interact with the app while driving if doing so would be unsafe or unlawful. To the extent not prohibited by law, JetMAX will not be liable for personal injury, death, or property damage arising from negligent or unsafe use of the Services.

5. License and Restrictions

Subject to these Terms, we grant you a limited, nonexclusive, non-transferable, revocable license to access and use the Services on a mobile device that you own or control, solely for your personal or internal business use as intended.

You agree not to (and not to authorize others to): distribute the Services over a network for concurrent use on multiple devices beyond what we expressly allow; rent, lease, lend, sell, redistribute, or sublicense the Services; copy, reverse engineer, decompile, disassemble, or create derivative works of the Services except to the extent such restriction is prohibited by law; or remove proprietary notices.

6. Paid Features and Subscriptions

JetMAX may offer paid subscriptions, premium plans, or in-app purchases. Pricing, billing terms, and included features will be disclosed at the time of purchase.

If a subscription is offered through Google Play, the Apple App Store, or another third-party platform, billing, renewals, cancellations, refunds, and payment processing may be governed in part by that third party’s terms and policies. Unless otherwise stated, subscriptions may automatically renew until canceled. You are responsible for managing and canceling your subscription through the applicable app store or payment provider.

Except where required by law, fees are non-refundable once charged. You are responsible for any taxes associated with your purchase, excluding taxes based on JetMAX’s net income.

7. Acceptable Use

You agree not to:

8. User Content

If you submit, upload, or otherwise provide content through the Platform (including trip classifications, notes, named locations, and reports you create), you retain ownership of your content, subject to any rights necessary for us to operate the Platform.

You grant JetMAX a non-exclusive, worldwide, royalty-free license to host, store, reproduce, modify, display, and use such content solely as necessary to operate, maintain, improve, and provide the Services.

You represent and warrant that you have all rights necessary to provide such content and that your content does not violate any law or third-party right.

9. Intellectual Property

The Platform, including its software, design, features, text, graphics, trademarks, service marks, logos, and other content, is owned by or licensed to JetMAX and is protected by applicable intellectual property laws.

Except as expressly permitted in these Terms, you may not copy, modify, distribute, sell, lease, license, display, perform, or create derivative works from the Platform or any part of it without prior written permission.

10. Third-Party Services

The Platform may contain links to third-party services or integrate with third-party tools, payment processors, app stores, analytics providers, mapping providers, or external platforms. We are not responsible for the content, policies, availability, or practices of third parties.

Use of Google Maps features and content is subject to the then-current Google Maps / Google Earth Additional Terms of Service and the Google Privacy Policy.

11. Disclaimers

THE PLATFORM AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.

WITHOUT LIMITING THE FOREGOING, JETMAX DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY INFORMATION, CALCULATIONS, MILEAGE LOGS, DISTANCES, ADDRESSES, DEDUCTION ESTIMATES, INSIGHTS, OR RECOMMENDATIONS PROVIDED THROUGH THE PLATFORM WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR YOUR PARTICULAR SITUATION.

JETMAX DOES NOT PROVIDE LEGAL, TAX, ACCOUNTING, INVESTMENT, EMPLOYMENT, OR FINANCIAL ADVICE, AND DOES NOT GUARANTEE ANY LEVEL OF INCOME, SAVINGS, TAX RESULT, REIMBURSEMENT, OR BUSINESS OUTCOME.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, JETMAX AND ITS AFFILIATES, OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE PLATFORM OR SERVICES.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF JETMAX FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE PLATFORM OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO JETMAX IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100).

Some jurisdictions do not allow certain limitations; in those cases, the above limitations apply to the maximum extent permitted by law.

13. Indemnification

You agree to defend, indemnify, and hold harmless JetMAX and its affiliates, owners, officers, employees, contractors, licensors, and service providers from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

14. Suspension and Termination

We may suspend, restrict, or terminate your access to the Platform at any time, with or without notice, if we believe you have violated these Terms, created risk for JetMAX or others, or if suspension or termination is otherwise necessary to protect the Platform, Users, or our legitimate interests.

You may stop using the Platform at any time. Termination does not affect rights or obligations that by their nature should survive termination.

15. Changes to the Platform or Terms

We reserve the right to update these Terms, the Platform, or the Services at any time. If we make material changes, we may provide notice through the Platform, by email, or by other reasonable means.

Your continued use of the Platform after the effective date of revised Terms constitutes your acceptance of the updated Terms.

16. Governing Law and Venue

These Terms and any dispute arising out of or related to the Platform or Services will be governed by the laws of Brazil, without regard to conflict-of-law principles that would require application of another jurisdiction’s laws, except that mandatory consumer-protection laws of your state of residence in the United States will apply to the extent they cannot be waived.

Unless otherwise required by applicable law, you agree that any legal action or proceeding arising out of or relating to these Terms or the Platform will be brought in the courts of the City of Rio de Janeiro, State of Rio de Janeiro, Brazil, and you consent to the personal jurisdiction of those courts. Nothing in this section limits your right to bring claims in small-claims court or to seek remedies that cannot be waived under applicable U.S. consumer law.

17. Electronic Communications

You agree that we may communicate with you electronically (for example, by email or in-app notices) and that such communications satisfy any legal requirement that communications be in writing.

18. Miscellaneous

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Our failure to enforce any provision of these Terms will not be considered a waiver of that provision or any other provision.

These Terms, together with the Privacy Policy and any additional terms presented to you for specific Services, constitute the entire agreement between you and JetMAX regarding the Platform.
