Respond Capture Services</h2><p>Respond Capture provides recruiting technology and related services for public-safety organizations. The Services may include:</p><ul><li>Recruitment websites and application forms</li><li>Applicant and candidate tracking</li><li>Candidate communications</li><li>Interview, deadline, and task reminders</li><li>Automated recruitment and nurture communications</li><li>Reporting and recruitment analytics</li><li>Tools used by participating public-safety agencies and their authorized personnel</li></ul><p> Some Services may be governed by a separate agreement between Respond Capture and a participating agency. If a separate written agreement conflicts with these Terms, that agreement controls for the applicable agency. </p></div><div><h2>2. Respond Capture Is Not the Employer</h2><p> Respond Capture provides technology and communication services to participating recruiting agencies. Respond Capture is not the employer, hiring authority, background investigator, or decision-maker for positions offered by those agencies. </p><p>Each participating agency is independently responsible for:</p><ul><li>Its job postings and application requirements</li><li>Its recruiting and hiring decisions</li><li>Communications sent on its behalf</li><li>Compliance with employment and public-sector hiring laws</li><li>The accuracy of information it provides through the Services</li></ul><p> Submitting an application or communicating through Respond Capture does not guarantee an interview, advancement, offer of employment, or employment. </p><p>Questions about a particular position, application, or hiring decision should be directed to the participating agency.</p></div><div><h2>3. Eligibility and Accounts</h2><p> You must provide accurate and current information when using the Services. If you create an account, you are responsible for protecting your credentials and for activity conducted through your account. </p><p>You may not:</p><ul><li>Use another person’s account without authorization</li><li>Misrepresent your identity, qualifications, or affiliation</li><li>Attempt to gain unauthorized access to the Services or another user’s information</li><li>Interfere with the security, availability, or operation of the Services</li><li>Use the Services for unlawful, fraudulent, abusive, or discriminatory purposes</li><li>Upload malicious software or content that infringes another party’s rights</li></ul><p>You must notify Respond Capture promptly if you believe your account or information has been accessed without authorization.</p></div>',4)),t("div",null,[e[3]||(e[3]=t("h2",null,"4. SMS and Text Messaging Terms</h2><h3>Program Description</h3><p> The Respond Capture Recruiting Messages program provides text messages from Respond Capture and participating recruiting agencies to people who have expressly opted in. </p><p>Messages may include:</p><ul><li>Application confirmations and status updates</li><li>Interview, testing, appointment, and deadline reminders</li><li>Document and task requests</li><li>Recruiter follow-ups</li><li>Responses to candidate questions</li><li>Automated messages related to an active recruiting process</li><li>Relevant information about recruiting opportunities</li></ul><h3>Consent</h3><p> You may opt in by entering your mobile telephone number on a Respond Capture-powered web form and selecting an optional, unchecked checkbox agreeing to re

1ceive text messages. </p><p> Consent to receive text messages is optional. It is not a condition of applying for employment, receiving consideration for a position, or purchasing any product or service. </p><h3>Message Frequency and Charges</h3><p> Message frequency varies based on your application activity, recruiting interactions, and the communications configured by the participating agency. </p><p><strong>Message and data rates may apply.</strong> Your wireless carrier’s standard messaging and data charges may apply to messages sent or received under this program.</p><h3>Opting Out</h3><p> You may reply <strong>STOP</strong> to any message to stop receiving text messages through that messaging program. After your request is processed, no additional messages will be sent unless you provide new consent. </p><p> You may reply <strong>HELP</strong> for assistance or contact Respond Capture at <a href="mailto:[email protected]" class="text-emerald-600 dark:text-emerald-400 hover:underline">[email protected]</a>. </p><p>Supported opt-out requests may also include CANCEL, END, QUIT, STOPALL, REVOKE, OPTOUT, or UNSUBSCRIBE.</p><h3>Delivery</h3><p> Wireless carriers are not responsible for delayed or undelivered messages. Intellectual Property</h2><p> The Services, including their software, designs, text, graphics, trademarks, logos, documentation, and other content, are owned by Respond Capture or its licensors and are protected by applicable intellectual-property laws. </p><p> Respond Capture grants you a limited, revocable, non-exclusive, non-transferable right to use the Services for their intended purpose. No ownership rights are transferred to you. </p><p> You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from the Services except where expressly permitted by law or a written agreement with Respond Capture. </p></div><div><h2>8. Third-Party Services and Links</h2><p> The Services may link to or integrate with third-party websites and services, including participating agency websites, job boards, communications providers, analytics providers, file-storage providers, and identity or authentication services. </p><p> Respond Capture is not responsible for third-party content, availability, security, or privacy practices. Your use of a third-party service may be governed by that provider’s terms and policies. </p></div><div><h2>9. Service Availability and Changes</h2><p> We may modify, suspend, or discontinue portions of the Services as our offerings evolve. We may also perform maintenance or make changes necessary for security, compliance, or reliability. </p><p> We do not guarantee uninterrupted or error-free availability. We will use commercially reasonable efforts to operate the Services reliably and protect the information entrusted to us. </p></div><div><h2>10. Disclaimer of Warranties</h2><p> To the fullest extent permitted by law, the Services are provided “as is” and “as available.” Respond Capture disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade. </p><p> Respond Capture does not guarantee employment outcomes, candidate qualifications, hiring decisions, message delivery, or the accuracy of information provided by participating agencies or other users. </p><p>Some jurisdictions do not permit certain warranty exclusions, so portions of this section may not apply to you.</p></div><div><h2>11. Limitation of Liability</h2><p> To the fullest extent permitted by law, Respond Capture and its officers, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost opportunities, loss of data, or interruption of service arising from use of the Services. </p><p>Respond Capture’s aggregate liability arising from these Terms or the Services will not exceed the greater of:</p><ol><li>The amount you paid directly to Respond Capture for the Services during the twelve months preceding the event giving rise to the claim; or</li><li>One hundred U.S. dollars.</li></ol><p>These limitations do not apply where prohibited by law.</p></div><div><h2>12. Governing Law</h2><p>These Terms are governed by the laws of the State of Oregon, without regard to conflict-of-law principles.</p><p> Unless a separate written agreement provides otherwise, legal proceedings relating to these Terms or the Services must be brought in the state or federal courts located in Deschutes County, Oregon, and the parties consent to those courts’ jurisdiction. </p></div><div><h2>14. Changes to These Terms</h2><p> We may update these Terms to reflect changes to the Services, our practices, or applicable requirements.
