It's horrible that she's not here anymore,â said LaTanya Walker, Tierra Walkerâs aunt and the lead plaintiff in the case, in a press conference Wednesday. She added: âI want justice for her. I want it to not happen to anyone else. It needs to stop.â\u003c/p\u003e\n\u003cp\u003eThe case, filed Tuesday in state court by a malpractice firm and the abortion rights group Amplify Legal, argues that Texasâ abortion bans violate both the state and U.S. Constitution. This case is also the first to directly sue Paxton, who \u003ca href=\"https://19thnews.org/2026/07/ken-paxton-abortion-views-texas-senate-race/\"\u003ehas taken a leading role \u003c/a\u003ein enforcing Texasâ ban. Paxton is locked in a tight race for the U.S. Senate.\u003c/p\u003e\n\u003cp\u003eâTierra Walker is dead and those responsible must be held accountable,â the suit reads. âAt every turn, Texasâs political and medical establishments not only failed but actively harmed Ms. Walker.â\u003c/p\u003e\n\u003cp\u003eWalker is one of the numerous women whose deaths have been linked to abortion bans. Other deaths have occurred in North Carolina and Georgia, states with bans less restrictive than Texasâ. \u003ca href=\"https://statutes.capitol.texas.gov/?tab=1\u0026amp;code=HS\u0026amp;chapter=HS.170A\u0026amp;artSec=170A.002\"\u003eTexasâ near-total abortion ban\u003c/a\u003e provides exceptions only if staying pregnant puts someone âat risk of death or poses a serious risk of substantial impairment of a major bodily function.â In 2025 â after Walkerâs death â the state \u003ca href=\"https://www.texastribune.org/2025/05/21/texas-abortion-exception-save-mothers/\"\u003epassed a law \u003c/a\u003emeant to clarify what constitutes a risk of death. But the penalties for violating the stateâs ban remain onerous, and many doctors have said it is not obvious what care they can provide or how sick a patient must be before they can intervene.\u003c/p\u003e\n\u003cp\u003eWalker, whose case was first reported on last year \u003ca href=\"https://www.propublica.org/article/texas-abortion-ban-tierra-walker-preeclampsia\"\u003eby ProPublica\u003c/a\u003e, died December 30, 2024, when she was 37 years old and 20 weeks into her pregnancy. Her medical history of chronic conditions â including diabetes, hypertension, obesity and severe asthma â made her pregnancy particularly high-risk. She was hospital
1ized multiple times during her pregnancy and repeatedly asked for an abortion. According to the lawsuit, doctors did not give her information on how she could get an abortion, instead dismissing her after telling her âyour baby is fine.â\u003c/p\u003e\n\u003cp\u003eâThey just kept saying, âIt's not the baby, the baby's fine,ââ LaTanya Walker said.\u0026nbsp;\u003c/p\u003e\n\u003cp\u003eWalker died days after being discharged from University Health, the hospital, according to the lawsuit. Her son discovered her dead on his 15th birthday.\u003c/p\u003e\n\u003cp\u003eAfter Walkerâs death, a medical examiner ruled that she died of hypertensive cardiovascular disease with preeclampsia, the latter of which is a dangerous pregnancy-related high blood pressure condition that doctors had identified in Walker.\u0026nbsp;\u003c/p\u003e\n\u003cp\u003eSome Texans have been able to get abortions by leaving the state or ordering abortion medication online. Walkerâs illness â\u0026nbsp;which included seizures and frequent hospitalizations â prevented her from traveling out of state, said Molly Duane, one of the familyâs attorneys. LaTanya Walker considered ordering abortion pills for her niece, she said, but she ultimately did not because she worried about whether they could exacerbate medical conditions.\u003c/p\u003e\n\u003cp\u003eâThat's the problem. You should be able to get healthcare from your doctor,â Duane said.\u003c/p\u003e\n\u003cp\u003eMedical records cited in the suit note that on her last hospital visit, her blood pressure was dangerously high and only temporarily responsive to medication. According to those records, the doctor caring for her at that point, who is a named defendant in the suit, wrote that âdelivering the babyâ â which would terminate the pregnancy â\u0026nbsp;âmay be the best treatment for preeclampsia.â\u0026nbsp;\u003c/p\u003e\n\u003cp\u003eDoctors who reviewed the case for ProPublica all told the news outlet that, given Walkerâs medical risks, she should have been offered an abortion.\u0026nbsp;
1\u003c/p\u003e\n\u003cp\u003eThe suit names Paxton and Stephen Brint Carlton, the executive director of the Texas Medical Board, in their official and individual capacities, as well as Bexar County District Attorney Joe Gonzales in his official capacity. In another case, he threatened legal action against anyone who gave an abortion to one woman â despite a court saying she qualified for an exception to the stateâs ban. Cory Booker asked if Flock cameras could be used to track women in states with strict abortion laws.\u003c/p\u003e\n\n \u003cp\u003eACLUâs Chad Marlow, senior policy counsel, said that it would be easy to track people searching for those services.\u003c/p\u003e\n\n \u003cp\u003eHawley agreed with Booker and also questioned how easy it would be to create a database of certain people, such as those who attend gun shows.\u003c/p\u003e\n\n \u003cp\u003eâWhen you have this amount of data available, the temptations to use it are going to be absolutely incredible, if not irresistible,â he said.\u003c/p\u003e\n\n \u003cp\u003eMarlow said the scenarios that Booker and Hawley cited are closer than they think.\u003c/p\u003e\n\n \u003cp\u003eâIf you build it, they will come,â he said. âI so much appreciate that you're bringing (up) abortion care seekers and gun owners because they are part of the same community when it comes to the threat of mass surveillance. It accounts for almost half of the cumulative global carbon emissions since the industrial era began â as much as oil and natural gas combined. And it generates much more carbon dioxide per unit of energy than either oil or gas. Most climate experts agree that phasing out coal power is the single biggest change the world could make to slow down global warming. \u003c/p\u003e\n\n\n\n\u003cp class=\"has-default-font-family wp-block-paragraph\"\u003eFor almost 20 years, the United States has whipsawed on the question of whether the federal government should try to speed up that phaseout. After Barack Obama failed to push a carbon tax through Congress, his administration drafted the âClean Power Plan,â which would have forced electric utilities to cut their emissions by shifting away from coal. President Donald Trump repealed that rule during his first term, and the Supreme Court later said that the president could not unilaterally force utilities to give up the fuel.\u003c/p\u003e\n\n\n\n\u003cp class=\"has-default-font-family wp-block-paragraph\"\u003eInstead of forcing utilities to abandon coal, the Biden administration tried to work around the Supreme Court ruling in its 2024 rule by giving utilities a choice. They could either retire their coal plants sometime in the 2030s, or they could equip them with new machines that would capture almost all the carbon dioxide that would come out of their smokestacks. The result either way would be a significant drop in carbon emissions from the power sector.\u003c/p\u003e\n\n\n\n\u003cp class=\"has-default-font-family wp-block-paragraph\"\u003eThe Trump administration is now repealing that rule. The Environmental Protection Agency announced on Monday that it plans to wipe away all federal regulations for carbon emissions from the electricity sector, essentially allowing utilities to warm the Earth as much as they want. The agency used the same justification as it did in its repeal of climate regulations on motor vehicles \u003ca href=\"https://grist.org/politics/trump-epa-endangerment-finding-greenhouse-gases/\"\u003eearlier this year\u003c/a\u003e, arguing that the science of climate change was uncertain and that the repeal would save consumers money on power bills.\u003c/p\u003e\n\n\n\n\u003cp class=\"has-default-font-family wp-block-paragraph\"\u003eâFor over 15 years, the Obama and Biden administrations implemented a war on co
1al to destroy reliable and affordable energy,â said Trumpâs EPA chief Lee Zeldin at an international energy summit in Texas. âWe are working to go even further so that American energy can be fully unleashed. Realizing the full potential of American energy means more jobs, lower prices, and a more prosperous America.â\u003c/p\u003e\n\n\n\n\u003cp class=\"has-default-font-family wp-block-paragraph\"\u003eThis repeal deals a significant blow to the federal governmentâs efforts to force the power sector away from coal. The whiplash between Democratic and Republican administrations has been so frequent and so severe that neither the Obama nor the Biden rules have done much to speed the \u003cspan class=\"tooltipsall tooltipsincontent classtoolTips4\"\u003edecarbonization\u003c/span\u003e of the power sector, especially when compared to other federal efforts like the Inflation Reduction Act \u003ca href=\"https://grist.org/energy/trump-inflation-reduction-act-big-beautiful-bil/\"\u003esubsidies for solar and wind\u003c/a\u003e.\u003c/p\u003e\n\n\n\n\u003cp class=\"has-default-font-family wp-block-paragraph\"\u003eâThe reason to have a target is that it sends a clear signal to decision-makers in companies,â said Kenneth Gillingham, a professor of environmental economics at Yale University and an economic adviser to the Obama administration, where he helped draft the Clean Power Plan. âIf youâre on the fence between choosing two things, you might as well choose the one thatâs in line with the target. Thatâs been undermined. There has to be some teeth behind it.â\u003c/p\u003e\n\n\n\n\u003cp class=\"has-default-font-family wp-block-paragraph\"\u003eEven though the Obama and Biden rules never took effect, coal power has still been plummeting in the United States over the past 20 years. Thatâs thanks to the shale fracking boom, which lowered the cost of natural gas and made it cheap for utilities to replace their coal plants with gas plants. When burned, natural gas does warm the Earth, but slower than coal, and the shift has caused overall power sector emissions to fall in the U.S. by almost half.\u003c/p\u003e\n\n\n\n\u003cp class=\"has-default-font-family wp-block-paragraph\"\u003eThe repeal of the Biden rule will likely delay that phaseout and will have significant effects for the nationâs public health. Coal plants also release harmful toxins like mercur
1y and particulate matter, leading to thousands of premature deaths around the world. Inasmuch as the Biden rule would have sped up coal closures, it would also have prevented around $370 billion in health damages from climate change and air pollution. The Biden administration \u003ca href=\"https://www.epa.gov/newsreleases/biden-harris-administration-finalizes-suite-standards-reduce-pollution-fossil-fuel\"\u003epredicted\u003c/a\u003e that in 2035, the rule would have prevented hundreds of thousands of asthma flare-ups, hundreds of emergency room visits, and more than 1,200 premature deaths.\u003c/p\u003e\n\n\n\n\u003cp class=\"has-default-font-family wp-block-paragraph\"\u003eThe artificial intelligence boom is also slowing the phaseout of coal. The Biden administration drafted its 2024 rule at a time when coal was expected to keep shrinking on its own; the rule \u003ca href=\"https://www.federalregister.gov/documents/2024/05/09/2024-09233/new-source-performance-standards-for-greenhouse-gas-emissions-from-new-modified-and-reconstructed\"\u003eprojected\u003c/a\u003e a âcontinued decline in projected coal-fired steam generating unit capacity as well as a steady decline in annual operation of those [plants] that remain online,â driven largely by âeroding economic opportunities for coal-fired steam generating units to operate.â Now the rapid growth in power demand from data centers has led to a resurgence in demand for coal plants, and has led many utilities to push out the retirement date for their legacy coal assets. For coal power plants that sell into wholesale markets like the Midwest and the mid-Atlantic, high prices have made it worthwhile to stay online. (The Trump administration has also \u003ca href=\"https://grist.org/energy/trump-wright-coal-retirement-data-center-mining/\"\u003eordered some coal plants\u003c/a\u003e to stay online past their planned retirements, a move that a federal court \u003ca href=\"https://earthjustice.org/press/2026/trump-administration-loses-first-court-case-challenging-doe-orders-for-coal-plants\"\u003efound to be unlawful\u003c/a\u003e earlier this month.)\u003c/p\u003e\n\n\n\n\u003cp class=\"has-default-font-family wp-block-paragraph\"\u003eA case in point is Southern Company, the massive utility that produces energy for states including Georgia and Mississippi. Under the Biden administration, the utility had planned to retire its major Mississippi coal plant by 2028, but Southern announced last year that data centers would necessitate keeping it online \u003ca href=\"https://www.documentcloud.org/documents/25502930-20250109-2019-ua-231-irp-update/?mode=document#document/p1/a2622183\"\u003ewell into the 2030s\u003c/a\u003e. The companyâs previous efforts to install carbon capture at its coal units, meanwhile, have \u003ca href=\"https://www.eenews.net/articles/the-kemper-project-just-collapsed-what-it-signifies-for-ccs/\"\u003eended in failure\u003c/a\u003e. Environmental groups have \u003ca href=\"https://energyandpolicy.org/southern-company-extends-life-of-coal-plants-to-power-data-centers-appears-to-abandon-net-zero-goal/\"\u003ecriticized these decisions\u003c/a\u003e and argued that AI demand is inflated, but the Trump administration is happy to give utilities leeway to keep coal online.\u003c/p\u003e\n\n\n\n\u003cp class=\"has-default-font-family wp-block-paragraph\"\u003eThe next president who seeks to take action on climate change will face much the same coal challenge that Obama did: how to speed up the phaseout of a fuel that is declining, but not dying? Gillingham argues that the short-term boost provided by Trump and the data center boom may not help rescue the coal fleet. The nationâs coal plants are only getting older, and many utilities will choose to replace them with gas or other fuels rather than repair them.
