By using Trading Bot Services, you agree to be bound by the Trading Bot Conditions, the Conditions, all rules and policies of the Group as may be published by the Group from time to time on the Interface, including but not limited to the BTSE Legal Disclaimers and the BTSE Privacy Policy. </p><p data-v-276fee0d> Trading Bot Services enable you to automate your trading with the use of various trading bots available through the Interface. </p><p data-v-276fee0d> All terms and references used in the Trading Bot Conditions, and which are defined and construed in the Conditions but are not defined or construed in the Trading Bot Conditions shall have the same meaning and construction in the Trading Bot Conditions, unless otherwise stated. </p><p data-v-276fee0d> The Trading Bot Conditions are to be read together with the Conditions. In the event of any conflict or inconsistency between the Trading Bot Conditions and the Conditions, the Trading Bot Conditions shall prevail. </p><p data-v-276fee0d> The Group may at any time and in its sole discretion change and update the Trading Bot Conditions and Trading Bot Services without further notice to you. Such changes shall apply to you immediately after the Group discloses and announces it on the Interface. If any change to Trading Bot Services is found invalid, void, or for any reason unenforceable, that change is severable and does not affect the validity and enforceability of any remaining changes or conditions. Your continued use of Trading Bot Services after such change constitutes your acceptance of the changes. </p><ul class="item-number" data-v-276fee0d><li class="item-i title" data-v-276fee0d><p id="anchor-1" class="text-title" data-v-276fee0d>Trading Bot Services</p><ul class="item-number-2" data-v-276fee0d><li class="item-i" data-v-276fee0d> Trading Bot shall mean the function in the Interface that allows you to set a price range whereby the Interface will assist you to set buy and/or sell orders of Digital Assets within the specified Trading Bot Parameters. You are allowed to have multiple active Trading Bots, running simultaneously. </li><li class="item-i" data-v-276fee0d> Trading Bot Parameters are the settings of the various Trading Bots which you are required to set prior to the creation and use of a Trading Bot. By using a Trading Bot, you provide authorization for Trading Bot to execute future transactions on your behalf. </li><li class="item-i" data-v-276fee0d> Trading Bot Services allow you to make the use of pre-set and automated trading within specific and clear parameters. By using Trading Bot Services, you acknowledge that you understand each of the different settings and parameters, and that the Trading Bot will conduct trading with your Account as long as all of the Trading Bot Parameters to trading (which are set by you) are met. Trading will continue indefinitely until the Trading Bot Parameters are no longer met or the Trading Bot is stopped. </li><li class="item-i" data-v-276fee0d> The expected yield displayed on the Interface is an estimation and the Group shall not be liable for any difference between the expected yield and your actual profit or loss generated through your use of Trading Bot Services. </li><li class="item-i" data-v-276fee0d> You agree and authorize the Group to take all reasonable actions (including but not limited to cancellation of transactions or disabling Account features under certain circumstances) at any time in order to safeguard the legitimate rights of you, the counterparty, and the Group. </li><li class="item-i" data-v-276fee0d> You understand that Trading Bot Services are provided by third-party service providers via the Interface to you and agree (i) to enter into any such contract with any such third-party service provider as may be considered necessary for the purpose of receiving Trading Bot Services; (ii) to provide any information and documents as requested by the third-party service providers for the purpose of conducting Know Your Customer and Anti-Money Laundering procedures; and (iii) be bound by the relevant terms and conditions or policies issued by such third-party service providers including but not limited to those listed in Appendix A. </li><li class="item-i" data-v-276fee0d> You agree and acknowledge that the third-party service providers are not under the control of Group so the Group makes no representations about, and accept no liability for, any Trading Bot Services provided by the third-party service providers. The Group is not responsible for the accuracy or reliability of any information, data, opinions, advice, or statements, as well as Trading Bot Services offered by the third-party service providers to you via the Interface. You agree and acknowledge that the Group shall not be responsible for any contract entered into, any transaction completed by Trading Bot Services, or any dispute raised, between you and such third-party service providers. There is no implied affiliation, endorsement, or adoption by the Group of any services provided by the third party service providers to you and the Group assumes no responsibility for, and specifically disclaims any liability, warranty, or obligation with respect to any content provided on or through these services. </li></ul></li><li class="item-i title" data-v-276fee0d><p id="anchor-2" class="text-title" data-v-276fee0d> Availability of Trading Bot Services </p><ul class="item-number-2" data-v-276fee0d><li class="item-i" data-v-276fee0d> The Group reserves the right to at any time change, discontinue, suspend, or terminate the support of Trading Bot Services without further notice to you. You agree to undertake any actions requested by the Group following the change, suspension or termination of Trading Bot Services. If the Group exercises the right to restrict or deny your access to Trading Bot Services or the Group discontinues or removes certain functionalities or features of Trading Bot Services, the Group is not responsible for any consequential delay, damage, or inconvenience such restriction causes. You agree that the Group is under no obligation to disclose the details of the reasons in relation to the change, suspension, or termination of Trading Bot Services. </li><li class="item-i" data-v-276fee0d> You agree and understand that the Group does not guarantee uninterrupted or error-free operations of the Trading Bot Services. You agree and understand that the Group is not obligated to correct defects or prevent third-party disruptions or unauthorized third-party access. In the event of the disruptions of Trading Bot Services resulting from your acts or omissions, acts by a hacker or other malicious actors, power outages, unavoidable technical failures, operational maintenance, network delays, computer system failures, Force Majeure Events, or any facts attributable to the third-party service providers, the support of Trading Bot Services may be delayed, paused, suspended, or deviated and the Group shall not be responsible for any loss incurred by you due to such event. </li><li class="item-i" data-v-276fee0d> You are responsible for configuring your information technology, computer programmes and platform or system to access Trading Bot Services. The Group does not guarantee that the Interface or Trading Bots will be free from bugs, defects, or viruses. The Group does not guarantee that any feature or functionality will work all the time as intended. </li></ul></li><li class="item-i title" data-v-276fee0d><p id="anchor-3" class="text-title" data-v-276fee0d>Risk Warning and Disclaimer</p><ul class="item-number-2" data-v-276fee0d><li class="item-i" data-v-276fee0d> To the fullest extent permitted by law, the Group (including our affiliates, directors, officers, employees, agents, representatives, partners, and licensors) expressly limit our liabilities in connection with or arising out of Trading Bot Services, to a maximum of the aggregate of fees you have paid us in association with the Trading Bot Services over the last twelve (12) months. </li><li class="item-i" data-v-276fee0d> The Trading Bot Services are provided by third-party service providers on an âas isâ basis, and your use of the Trading Bot Services is at your own risk and in acknowledgement of the risks disclosed in the Trading Bot Conditions. </li><li class="item-i" data-v-276fee0d> You understand that there may be gains or losses if you use Trading Bot Services and the Group shall not be responsible for any losses incurred due to your use of Trading Bot Services. </li><li class="item-i" data-v-276fee0d> The Group shall not be liable for any losses caused by your settings and inputs into the Trading Bot Parameters for your Trading Bot. </li><li class="item-i" data-v-276fee0d> You agree and shall examine your objectives, financial resources, and risk tolerance to determine whether to use Trading Bot Services. The Group makes no representation or warranty, express or implied, to the full extent not prohibited by applicable law, regarding the advisability of your use of Trading Bot Services on the Interface. </li><li class="item-i" data-v-276fee0d> You acknowledge that you have sufficient investment knowledge and experience of using Trading Bot to conduct transactions, and can bear the risks associated with such types of transactions, and agree to independently bear all the risks arising from the trades by using Trading Bot. You agree to exercise reasonable care, skill, and diligence before proceeding with any transaction via Trading Bot. </li><li class="item-i" data-v-276fee0d> You acknowledge that the Group is not a party providing Trading Bot Services and, thus, to the maximum extent permissible by law, you agree to hold harmless the Group, its employees, and directors of any and all losses resulting from the use of Trading Bot Services and any disputes between you and the third-party services providers of Trading Bot Services. </li><li class="item-i" data-v-276fee0d> The Group expressly disclaims all warranties and representations (for example, warranties of merchantability, fitness for a particular purpose, and n
1on-infringement) of Trading Bot Services. </li><li class="item-i" data-v-276fee0d> You understand and agree that you use Trading Bot Services at your own risk. This section is not exhaustive and does not disclose all the risks associated with Trading Bot Services. You shall carefully consider whether such use is suitable for you considering your circumstances and financial resources. </li></ul></li><li class="item-i title" data-v-276fee0d><p id="anchor-4" class="text-title" data-v-276fee0d>Warranty</p><ul class="item-number-2" data-v-276fee0d><li class="item-i" data-v-276fee0d> You represent and warrant that (i) you have the right to the Digital Assets in your Account on the Interface. They are free and clear of all liens and encumbrances and they are not derived from money laundering, terrorist financing, fraud or any other illegal or criminal activity under any applicable law in the respective jurisdiction; (ii) you are not located in or a national or resident of any jurisdiction where your use of the Trading Bot Services would be illegal or otherwise violate any applicable law or regulation of that jurisdiction; (iii) you were not, in any manner or form, solicited to use the Trading Bot Services prior to your creation of an Account on the Interface; (iv) you acknowledge and accept the risks associated with the use of the Trading Bot Services; and (v) you were given the opportunity to ask questions of and receive answers from the Group concerning the Trading Bot Services and have contacted Support regarding any questions you may have prior to starting to use the Trading Bot Services. </li><li class="item-i" data-v-276fee0d> You agree to indemnify, defend and hold the Group and its respective officers, directors, employees, and affiliates harmless from and against any and all third-party claims, demands, liabilities, costs or expenses, including attorneyâs fees and costs, arising from, or related to any breach by you of any of the Trading Bot Conditions or any violation by you of any applicable law. </li><li class="item-i" data-v-276fee0d> You warrant that you will continue to monitor and review your Trading Bot Parameters and performance of your Trading Bots throughout your use of the Trading Bot Services.
