75

76
77
LICENSE AGREEMENT AND DISTRIBUTION RULES:

78

79	1 Copyrights of the ENBSeries (the SOFTWARE) exclusively belongs to AUTHOR - Vorontsov Boris (ENB developer).
80
81	2 ENBSeries is DonateWare application (freeware), which means you may or may not pay for this software to the author as donation.
82
83	3 Software provided "AS IS", without warranty of any kind, use it on your own risk.
84
85	4 You agree not to change or remove any parts of software (files in archive or installer) without AUTHOR permission. Decompilation, reverse enginering, disassembling, debugging or changing resources of software is strictly prohibited.
86
87	5 You may use and distribute software for non-commercial purposes. For commercial usage it is required to warn about using this software (in credits, on the box or other places). Commercial distribution of software as part of the games without author permission prohibited. Commercial or non-commercial distribution via third-party download manager software is strictly prohibited.
88
89	6 The AUTHOR reserves the right to change this license agreement.
90
91	7 All the rights, not described in this license agreement belongs to the AUTHOR.
92
93	8 You are allowed to add new files to the ENBSeries archive or installer.
94
95	9 You may sell presets, shaders, bitmaps, documentation and any other components for ENBSeries, except binary files (.DLL, .EXE) created by the AUTHOR of ENBSeries.
96
97	10 Custom presets, shaders, bitmaps, documentation and any other components for ENBSeries belongs to their authors and may be copyrighted.
98
99
Section X. Protection of Variable Architecture and Proprietary Specification
100
The specific naming conventions, parameter structures, variable identifiers (including but not limited to unique tokens such as "AmbientLightingIntensityNight"), and the internal logic arrangement of the ENBSeries configuration files constitute the unique software architecture and intellectual property specification of the Author. Third-party developers are strictly prohibited from developing, distributing, or utilizing automated software, scripts, parsers, or conversion utilities designed to programmatically map, extract, or translate these proprietary parameter names for use in competing, alternative, or open-source software environments. This restriction does not apply to individual Asset Authors who choose to manually adapt, rewrite, or convert their own original configuration values for alternative platforms.
101
102
In furtherance of protecting this proprietary architecture:
103
104
X.1. Using third-party software, wrappers, hooks, compatibility layers, scripts, AI, or tools to load, execute, parse, read, interpret, or convert presets, shaders, bitmaps, scripts, proprietary configuration structures, or any other resources created for ENBSeries is strictly prohibited. Any automation designed to replicate the SOFTWARE's unique parameters or translate them into alternative shading formats without the AUTHOR's explicit written permission constitutes a breach of this Agreement.
105
106
X.2. Advanced Technical Extraction, Interception, and Manipulative Testing Prohibited
107
The prohibitions under Section X and Section X.1 strictly extend to the following methods of unauthorized data exploitation by competing or alternative software developers:
108
(a) Obfuscated and Hashed Mapping: Developing or utilizing any translation matrices, automated scripts, or database lookups that bypass variable name restrictions by using cryptographic hashes, numeric indexes, or structural offsets to identify and algorithmically map ENBSeries parameters into alternative shading formats.
109
(b) Runtime Frame and State Interception: Utilizing runtime injection, memory scraping (RAM parsing), memory debuggers, or graphics API hooks to intercept, monitor, extract, or mirror the volatile memory states, constant buffers, shader registers, or live rendering outputs generated by ENBSeries for the purpose of driving or calibrating alternative rendering engines.
110
110(c) Deceptive Comparative Benchmarking: Utilizing the SOFTWARE, its internal assets, or configurations to conduct non-objective, automated comparative testing or benchmark utilities designed to disparage, misrepresent, or discredit the performance and architecture of ENBSeries for the commercial promotion or audience redirection toward alternative software products.
111
112
[Good Faith Exception for Community Developers]:
113
The restrictions set forth in Section X, X.1, and X.2 (including memory reading, runtime interfacing, and state synchronization) do NOT apply to non-competing, non-commercial utilities, tools, scripts, or SKSE plugins (such as weather allocators, framework helper tools, camera systems, or gameplay-integrated modifications) designed in good faith to interface with ENBSeries at runtime solely for the purpose of extending, enhancing, or synchronizing the official ENBSeries environment within the game. Interoperability, memory integration, and variable reads are permitted exclusively for software that operates alongside and in support of ENBSeries, not as a mechanism to replace or displace it.
114
115
Section Y. Unregistered Trade Name and Brand Protection (Common Law Trademark)
116
The names "ENBSeries", "ENB", and associated branding elements are protected under Common Law Trademark and Unfair Competition laws (including Section 43(a) of the Lanham Act in the USA and the doctrine of Passing Off in the United Kingdom). The Author possesses exclusive goodwill and commercial reputation over these terms. No third-party developer may use the "ENBSeries" or "ENB" names, trademarks, or trade identity to market, promote, or describe the compatibility, translation, or conversion capabilities of alternative rendering software. Any marketing or technical claim asserting direct functional replication or automated conversion of ENBSeries configurations is an unauthorized exploitation of the Author's brand identity.
117
118
No third-party developer of alternative rendering software may use "ENB", "ENBSeries", "Vorontsov", or closely resembling derivatives in their software’s metadata, search tags, hidden keywords, or hidden documentation to artificially redirect user searches or manipulate search algorithms on modding platforms (including but not limited to Nexus Mods and GitHub). Marketing by implication, oblique reference, or derogatory comparison targeting the SOFTWARE’s architecture to imply functional substitution is strictly prohibited as an act of unfair competition.
119
120
Section Z. Ecosystem Integrity and Conditional Distribution of Configurations
121
All configuration datasets, presets, and .ini files specifically authored, structured, or formatted to interface with the proprietary environment of the ENBSeries software are engineered exclusively to operate within the proprietary architecture of ENBSeries. Custom Asset Authors retain full ownership and commercial distribution rights (including the right to sell or monetize their configurations) over their custom datasets. However, the authorization granted to third parties to host, distribute, or programmatically process these configuration assets is strictly conditional upon these files being used within the official ENBSeries environment. Any automated execution, bulk extraction, or algorithmic migration of these datasets by unauthorized third-party cross-compilers or conversion utilities is expressly unauthorized. The original Asset Authors remain fully permitted to personally migrate or re-license their own individual works for any alternative platform as they see fit.
122
123
In furtherance of protecting this ecosystem integrity:
124
125
Z.1. Unauthorized third-party conversion, extraction, migration, or translation—whether manual or automated—of presets, shaders, bitmaps, scripts, configurations, or any other resources created for ENBSeries without the explicit, verifiable permission of their respective creators (Asset Authors) is strictly prohibited. Asset Authors retain full ownership and copyrights of their custom assets as per Section 10, including the right to distribute or sell them, but this does not grant third-party software developers the right to bypass Section X or Section Z. Any permission granted by an Asset Author to a third party cannot override, waive, or invalidate the structural, architectural, and anti-automation restrictions imposed on the SOFTWARE under Section X, X.1, and X.2.
126
127
Z.2. Prohibition of Collaborative Mapping and Crowd-Sourced Extraction
128
The prohibition on automated parsing and conversion extends to the creation, distribution, or utilization of centralized or crowd-sourced databases, mapping tables, or translation matrices designed to bridge ENBSeries parameter architectures with alternative software environments. Third-party developers may not solicit, integrate, or utilize user-contributed conversion maps that rely on the unique intellectual property specification and variable names of ENBSeries to facilitate automated or semi-automated asset migration into competing software products.
129
130	13 Utilizing the SOFTWARE's ecosystem, including user-made presets, configurations, and assets, to promote, develop, or enhance alternative software with the intent to misappropriate the SOFTWARE's user base, constitutes Unfair Competition and Trademark/Copyright Misuse. Any activity that combines technical extraction of the SOFTWARE's structural data with black PR, defamation, and misinformation campaigns against the AUTHOR is a severe violation of this Agreement. The AUTHOR reserves the right to immediately revoke the right to use or distribute the SOFTWARE and its derivative components from any individual or entity engaging in such anticompetitive behavior.
131
132
133	By executing ENBSeries or using its components, you accept the terms of use and this license agreement.
