OpenCreators provides an AI-assisted platform that helps creators build and operate online storefronts, connect with their audiences, offer digital content and services, promote selected games, and manage related transactions and earnings.

This Privacy Policy explains how OpenCreators ("OpenCreators," "we," "our," or "us") collects, uses, discloses, and protects personal information when you use our websites, mobile applications, creator storefronts, dashboards, APIs, communications, and related products and services (collectively, the "Services"). It also describes the choices and rights available to you.

This Privacy Policy applies to creators, customers, fans, storefront visitors, prospective users, and other people who interact with the Services. It does not apply to third-party websites, platforms, or services that have their own privacy policies.

## 1. Who We Are

The entity responsible for the processing described in this Privacy Policy is:

**LIGHTHUNTER PTE. LTD.**
**73 UBI ROAD 1, #07-62 OXLEY BIZHUB, SINGAPORE 408733**
**Privacy contact:** [email protected]

Where applicable law uses the terms "controller," "business," or similar terms, LIGHTHUNTER PTE. LTD. is the controller or business responsible for your personal information, except where this Privacy Policy states otherwise.

## 2. The Personal Information We Collect

The information we collect depends on how you interact with the Services and which features you use.

### 2.1 Information You Provide to Us

- **Account and identity information:** your name, display name, username, avatar, email address, phone number, country or region, language, organization, and account identifiers.
- **Authentication information:** password hashes, one-time verification codes, session identifiers, and information used for single sign-on or multi-factor authentication. If you sign in through Google, Apple, TikTok, or another provider, we receive information permitted by that provider and your settings.
- **Creator profile and storefront information:** your biography, creator category, content topics, social links, website links, storefront handle, profile image, branding, themes, product descriptions, pricing, currency, availability, and other information you choose to publish.
- **Product and fulfillment information:** information used to create and deliver Custom Offers, Digital Products, Gaming Affiliates listings, and 1:1 Video Sessions. This may include descriptions, files, images, audio, instructions, customer requirements, schedules, and delivery records.
- **Communications and support information:** messages exchanged through private chat, communications between creators and customers, support requests, feedback, survey responses, and other communications you send through the Services.
- **Transaction and payout information:** order details, transaction amounts, currencies, receipts, refunds, commissions, wallet activity, withdrawal requests, billing information, payout preferences, tax information, and information needed to verify eligibility for payments. Payment and payout providers may collect card, bank-account, identity-verification, or tax information directly from you. We do not store complete payment-card numbers unless expressly stated at the point of collection.
- **Scheduling and video-session information:** booking details, time zone, availability, attendee information, session status, and technical metadata relating to a 1:1 Video Session. If a session may be recorded or transcribed, we will provide a separate notice and obtain any consent required by law before recording begins.
- **AI interactions:** prompts, instructions, source information you submit for analysis, generated suggestions, edits, feedback, and other interactions with AI-assisted features.

Please do not include sensitive personal information in profiles, products, private messages, files, prompts, or video sessions unless it is necessary for the relevant feature and you are permitted to provide it.

### 2.2 Information From Connected Platforms and Other Sources

If you connect a social-media account or provide a public profile link, we may collect information from or about that account according to your authorization, the platform's rules, and your privacy settings. Depending on the connection, this may include:

- profile name, username, avatar, biography, and account ID;
- public posts, content categories, links, and other publicly available profile information;
- audience size, engagement, performance metrics, and similar analytics;
- access tokens, permissions, connection status, and other integration data; and
- information needed to attribute activity, prevent fraud, or maintain the connection.

We may also receive information from payment and payout providers, authentication providers, game and affiliate partners, analytics and security providers, creators or customers involved in a transaction, and publicly available sources.

You can disconnect a connected platform through the relevant account settings where this option is available. Disconnecting stops future collection through that connection but does not automatically delete information we previously collected or information we must retain for legitimate business or legal purposes.

### 2.3 Information Collected Automatically

When you use the Services, we and our service providers may automatically collect:

- IP address, approximate location derived from IP address, device type, operating system, browser type, app version, language, and time zone;
- cookie identifiers, advertising identifiers where permitted, session data, and similar identifiers;
- pages and screens viewed, links and buttons selected, searches, feature interactions, referral URLs, access times, and navigation paths;
- storefront visits, product views, checkout activity, purchases, affiliate referrals, conversions, and attribution data; and
- crash reports, diagnostics, logs, performance information, fraud signals, and security events.

## 3. How We Use Personal Information

We use personal information to:

- provide, maintain, and improve the Services;
- create and manage accounts, creator profiles, public storefronts, products, and social-platform connections;
- analyze creator information and provide AI-assisted profile, storefront, content, product, and business suggestions;
- publish information that a creator chooses to make public on a storefront;
- enable customers to discover, purchase, book, access, or receive creator products and services;
- support Custom Offer fulfillment through private chat, Digital Product delivery, Gaming Affiliates attribution and commissions, and 1:1 Video Session scheduling and delivery;
- process payments, refunds, commissions, wallet activity, payouts, tax reporting, and transaction records;
- authenticate users, maintain account security, detect fraud or abuse, enforce our terms, and protect users and the Services;
- personalize content, recommendations, language, currency, templates, and other aspects of the user experience;
- provide customer support and respond to questions, complaints, and requests;
- send transactional, security, product, and service communications;
- send marketing communications where permitted by law and honor opt-out requests;
- monitor performance, troubleshoot problems, conduct analytics, test features, and develop new products;
- comply with law, respond to valid legal requests, establish or defend legal claims, and protect rights, safety, and property; and
- carry out other purposes described at the time information is collected, with consent where required.

## 4. Legal Bases for Processing

If the laws of the European Economic Area, United Kingdom, Switzerland, or another jurisdiction require us to identify a legal basis, we rely on one or more of the following:

- **Performance of a contract:** to create your account, provide requested features, process transactions, deliver products or sessions, and administer payouts.
- **Legitimate interests:** to operate and improve the Services, secure accounts, prevent fraud, understand product usage, provide relevant recommendations, and communicate with users, provided those interests are not overridden by your rights and interests.
- **Consent:** where you authorize a platform connection, enable optional cookies, receive certain marketing, submit information for an optional use, or where consent is otherwise required.
- **Legal obligations:** to maintain records, respond to lawful requests, meet tax and financial obligations, and comply with applicable law.
- **Protection of vital interests or other lawful grounds:** where permitted and appropriate under applicable law.

You may withdraw consent at any time. Withdrawal does not affect processing that occurred before consent was withdrawn, and some features may no longer be available if they depen
d on that consent.

## 5. AI-Assisted Features and Automated Processing

OpenCreators uses AI-assisted systems to analyze information you provide or authorize and to generate suggestions such as creator positioning, biographies, storefront designs, product ideas, descriptions, and recommendations. AI-generated output may be inaccurate or incomplete, and creators remain responsible for reviewing content before publishing or using it.

We may process AI interactions, including prompts, inputs, and outputs, to provide the requested feature, maintain safety and security, troubleshoot problems, evaluate quality, improve model quality, and improve the Services. We may use service providers to process this information on our behalf. Where required by law, we provide additional notice, request consent, or offer applicable choices.

We may also use automated tools to detect fraud, abuse, security threats, or violations of our terms. Where required by law, we will provide information about solely automated decisions that produce legal or similarly significant effects and offer applicable rights to request human review or challenge a decision.

## 6. When Information Is Public or Shared With Other Users

Creator storefronts are intended to be publicly accessible. Information a creator publishes—such as a name, avatar, biography, social links, product listings, prices, recommendations, and storefront handle—may be viewed, copied, indexed, or shared by others.

When a customer purchases, books, or requests a creator's product or service, we may share information necessary to complete the transaction with that creator, such as the customer's name, contact details, order details, requirements, messages, or booking information. Customers should review any privacy information provided by the creator. A creator may be independently responsible for personal information they receive and use outside OpenCreators.

Creators must handle customer information only for lawful purposes and in accordance with our terms and applicable law.

## 7. How We Disclose Personal Information

We may disclose personal information to the following recipients:

- **Service providers:** companies that provide cloud hosting, storage, content delivery, analytics, c
ommunications, customer support, security, fraud prevention, identity verification, AI infrastructure, and other operational services on our behalf.
- **Payment and payout providers:** providers that process customer payments, refunds, creator payouts, tax information, financial verification, and related compliance checks.
- **Authentication and connected-platform providers:** services such as Google, Apple, TikTok, Instagram, and YouTube when you choose to sign in, connect an account, or interact with those platforms.
- **Creators and customers:** as needed to complete a purchase, booking, Custom Offer, Digital Product delivery, private-chat interaction, or 1:1 Video Session.
- **Game and affiliate partners:** as needed to provide Gaming Affiliates listings, track referrals and conversions, calculate commissions, prevent fraud, and administer payouts.
- **Professional advisers:** auditors, lawyers, accountants, insurers, and other advisers where reasonably necessary.
- **Authorities and other parties for legal or safety reasons:** where we reasonably believe disclosure is required by law or necessary to protect rights, safety, property, users, or the Services; investigate fraud or security incidents; or enforce agreements.
- **Parties to a corporate transaction:** in connection with a merger, financing, acquisition, reorganization, bankruptcy, sale of assets, or similar transaction, subject to appropriate safeguards.
- **Other parties at your direction or with your consent.**

We may use and disclose aggregated or de-identified information that cannot reasonably be linked to an individual. We will not attempt to re-identify information we maintain as de-identified except as permitted by law.

OpenCreators does not sell personal information or share personal information for cross-context behavioral advertising as those terms are defined under applicable California law.

## 8. Cookies and Similar Technologies

We use cookies, SDKs, pixels, local storage, and similar technologies to:

- keep you signed in and provide core features;
- remember preferences such as language, currency, and storefront settings;
- maintain security and prevent fraud;
- understand how the Services perform and are used; and
- support advertising or campaign measurement where permitted and disclosed.

Where required, we ask for consent before using non-essential technologies. You can manage available choices through your browser or device settings and any preference controls we make available. Blocking some technologies may affect how the Services work.

## 9. Data Retention

We retain personal information only for as long as reasonably necessary for the purposes described in this Privacy Policy, including to provide the Services, maintain security, comply with legal, tax, accounting, and reporting obligations, resolve disputes, and enforce agreements.

Retention periods depend on factors such as the type and sensitivity of the information, the feature involved, whether the account remains active, legal requirements, applicable limitation periods, and security needs. When information is no longer required, we delete or de-identify it, subject to technical limitations in backups and lawful retention requirements.

Deleting an account may not immediately remove information that:

- appears in completed transaction, tax, payout, fraud-prevention, or dispute records;
- another user is independently entitled or required to retain;
- has already been made public or copied outside the Services; or
- remains temporarily in protected backups before scheduled deletion.

## 10. International Data Transfers

OpenCreators and its service providers may process personal information in countries other than the country where you live. Those countries may have different data-protection laws.

Where required, we use recognized safeguards for international transfers, such as adequacy decisions, approved contractual clauses, or other lawful transfer mechanisms. You may contact us to request more information about safeguards relevant to your personal information.

## 11. Security

We use reasonable administrative, technical, and organizational measures designed to protect personal information, including measures such as access controls, encryption in transit, monitoring, and security reviews. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.

You are responsible for maintaining the confidentiality of your login credentials and for promptly notifying us if you suspect unauthorized access to your account.

## 12. Your Privacy Rights and Choices

Depending on where you live, you may have the right to:

- request access to personal information we hold about you;
- request correction of inaccurate or incomplete information;
- request deletion of personal information;
- request restriction of or object to certain processing;
- receive a portable copy of certain information;
- withdraw consent where processing is based on consent;
- opt out of marketing communications;
- opt out of certain sales, sharing, targeted advertising, or profiling where applicable;
- appeal our response to a privacy request where applicable; and
- lodge a complaint with a data-protection or privacy authority.

You may update certain information through your account settings, manage connected-platform permissions through OpenCreators and the relevant platform, and unsubscribe from marketing emails using the link in the message. We may continue to send non-promotional messages about your account, transactions, security, or the Services.

To exercise a privacy right, contact us at [email protected]. Please describe your request and the account or information involved. We may need to verify your identity and authority before completing the request. You may use an authorized agent where permitted by law. We will not discriminate against you for exercising a privacy right.

Rights are subject to applicable exceptions. If we cannot fulfill a request, we will explain the reason where required by law.

## 13. Additional Information for California Residents

If the California Consumer Privacy Act, as amended ("CCPA"), applies to our processing, California residents may request information about the categories and specific pieces of personal information we collect, the sources and purposes of collection, and the categories of recipients to whom information is disclosed. They may also request correction or deletion and exercise applicable rights to opt out of sale, sharing, or certain uses of sensitive personal information.

The categories described in Section 2 may correspond to the following CCPA categories: identifiers; customer records; commercial information; internet or other electronic-network activity; geolocation data; audio, electronic, visual, or similar information; professional or employment-related information where provided; sensitive personal information such as account credentials or financial information; and inferences drawn from other information.

We use and disclose these categories for the business and commercial purposes described in Sections 3 and 7 and retain them according to the criteria described in Section 9. We do not sell these categories or share them for cross-context behavioral advertising as those terms are defined by the CCPA.

California residents may submit requests using the method in Section 12.

## 14. Children and Young People

The Services are not directed to children below the minimum age required by applicable law to use the Services or consent to the processing of personal information, and we do not knowingly collect personal information from children who cannot lawfully provide that c
onsent. Users who create products, receive payouts, or enter into commercial transactions may be subject to additional age or eligibility requirements.

If you believe a child has provided personal information contrary to this section, contact us at [email protected]. We will investigate and take appropriate action, including deletion where required.

## 15. Third-Party Services

The Services may link to or integrate with third-party services, including social platforms, game publishers, payment providers, video-service providers, and creator websites. Their handling of personal information is governed by their own terms and privacy policies. OpenCreators is not responsible for independent third-party privacy practices.

## 16. Changes to This Privacy Policy

We may update this Privacy Policy to reflect changes to the Services, our practices, or applicable law. We will update the "Last updated" date when we make changes. 220`,i=`# OpenCreators Terms of Service

**Last updated: August 26, 2026**

These Terms of Service ("Terms") are a legally binding agreement between you and **LIGHTHUNTER PTE. LTD.**, doing business as OpenCreators ("OpenCreators," "we," "our," or "us"). These Terms govern your access to and use of our websites, mobile applications, creator storefronts, dashboards, APIs, communications, and related products and services (collectively, the "Services").

By creating an account, selecting a button that indicates acceptance, purchasing or selling through the Services, or otherwise using the Services, you agree to these Terms. Our Privacy Policy explains how we handle personal information. If you do not agree to these Terms, do not use the Services.

Additional terms or policies may apply to a particular feature, product, promotion, or transaction. If additional terms conflict with these Terms, the additional terms control for that feature, product, promotion, or transaction to the extent of the conflict.

## 1. Eligibility and Authority

You must have the legal capacity to enter into these Terms. If you have not reached the age of majority where you live, a parent or legal guardian must review and agree to these Terms on your behalf and supervise your use of the Services. Additional age, identity, location, or eligibility requirements may apply to creators, customers, payouts, payment methods, Gaming Affiliates, or particular products.

If you use the Services for a company, agency, or other organization, you represent that you have authority to bind that organization. In that case, "you" includes both you and the organization.

You may not use the Services if we previously suspended or terminated your account, unless we give you written permission, or if applicable law prohibits your use.

## 2. Accounts and Security

You agree to:

- provide accurate, complete, and current account information;
- maintain only the accounts you are authorized to use;
- keep your login credentials and verification codes confidential;
- promptly update information that affects your account, transactions, taxes, or payouts; and
- notify us at [email protected] if you suspect unauthorized access or misuse.

You are responsible for activity under your account to the extent permitted by law. You may not sell, transfer, rent, or share an account or credentials except through an OpenCreators feature that expressly permits authorized team access.

We may require identity, age, business, tax, payment, or payout verification. Failure to complete a required check may limit or suspend access to some features.

## 3. What OpenCreators Provides

OpenCreators is an AI-assisted creator-commerce platform. The Services may allow creators to:

- connect public profiles or authorized social-platform accounts;
- generate and customize a public creator profile or storefront;

- publish social links, products, services, and recommendations;
- sell Digital Products or fulfill Custom Offers through private chat;

Visitors and customers may use the Services to browse creator storefronts, communicate with creators, purchase or access products, and book services.

We may make different features available based on location, device, account status, eligibility, or product stage. A prototype, beta feature, waitlisted feature, or feature described in product materials may not be generally available.

## 4. The Relationship Between OpenCreators, Creators, and Customers

OpenCreators provides technology that enables creators and customers to connect and transact. Unless the checkout page or product listing expressly identifies OpenCreators or another party as the seller, the creator is the seller and is responsible for the product or service offered to the customer.

OpenCreators is not an employer, agent, partner, joint venturer, or representative of a creator or customer solely because they use the Services. Creators independently decide what lawful products or services to offer, how to describe them, and how to fulfill them, subject to these Terms and applicable product rules.

Creators are responsible for:

- having the rights, qualifications, licenses, and permissions needed for their products, content, claims, and services;
- accurately describing pricing, deliverables, eligibility requirements, timing, limitations, and material terms;
- fulfilling purchases and bookings as promised;
- providing legally required disclosures, including advertising and affiliate disclosures;
- handling customer information lawfully and only for appropriate purposes;
- complying with consumer-protection, advertising, tax, privacy, intellectual-property, and other applicable laws; and
- responding to customer questions, complaints, cancellation requests, and disputes.

Customers are responsible for reviewing a listing before purchasing, providing accurate information, cooperating with reasonable fulfillment requirements, and using purchased content or services only as permitted.

We may facilitate communications, refunds, or disputes, but we do not guarantee the quality, legality, accuracy, safety, availability, or suitability of a creator's product or a customer's conduct.

## 5. Product-Specific Terms

### 5.1 Custom Offers

A Custom Offer is creator-defined content or a service fulfilled manually through private chat. The creator must clearly describe what the customer will receive, the expected delivery time, any information the customer must provide, the number of permitted revisions if applicable, and any material limitations.

Creators and customers must not use Custom Offers to exchange unlawful, infringing, unsafe, deceptive, or prohibited content. A creator may not request unnecessary sensitive personal information. A customer may not redistribute delivered content unless the listing or creator gives permission.

### 5.2 Digital Products

A Digital Product is downloadable or electronically delivered content made available after purchase. Creators must have the right to sell and distribute every included file and must ensure that product descriptions accurately explain the format, compatibility, access method, and license provided to the customer.

Unless a listing states otherwise, a purchase gives the customer a limited, personal, non-exclusive, non-transferable license to use the Digital Product for personal purposes. It does not transfer copyright or permit resale, public distribution, sublicensing, or removal of ownership notices.

Customers should download or securely save purchased files within any access period disclosed at checkout. We may restrict access to content that violates these Terms or the law.

### 5.3 Gaming Affiliates

Gaming Affiliates allows eligible creators to select games from a curated catalog, publish recommendations, and potentially earn commissions from qualifying, attributed transactions.

Commission rates, eligibility criteria, attribution windows, supported markets, qualifying events, payment timing, and other campaign rules may vary by game or partner and will be disclosed in the Services. Displayed rates or estimated earnings are not a guarantee of payment.

A commission may be rejected, reversed, withheld, or adjusted if a transaction is canceled, refunded, charged back, duplicated, fraudulent, ineligible, incorrectly attributed, or otherwise excluded under the applicable campaign rules.

Creators participating in Gaming Affiliates must:

- provide honest recommendations and clearly disclose the commercial or affiliate relationship where required;
- comply with applicable advertising rules and the relevant game publisher's or partner's requirements;
- avoid false claims, misleading endorsements, spam, cookie stuffing, self-referrals, artificial traffic, or manipulation of attribution; and
- not market an age-restricted game to an audience that is not legally eligible for it.

OpenCreators may modify or end a campaign, remove a game, or change future commission terms. Changes will not reduce a commission already earned and confirmed except where adjustment is permitted by the campaign rules or law.

### 5.4 1:1 Video Sessions

A 1:1 Video Session is a private one-to-one video interaction between a creator and a customer. Creators must accurately describe the session topic, duration, availability, prerequisites, rescheduling terms, and any follow-up materials.

Participants must behave lawfully and respectfully and may not record, photograph, stream, transcribe, or redistribute a session without all required notices, permissions, and consents. OpenCreators may provide technical infrastructure or use a third-party video provider but does not guarantee that a participant will attend or that a session will achieve a particular result.

Creators may not present regulated professional advice or services unless they are legally qualified and permitted to do so. Content provided in a session is not medical, legal, financial, mental-health, or other regulated professional advice unless the qualified creator expressly states otherwise and applicable law permits the service.

## 6. Orders, Pricing, Payments, and Refunds

Prices and supported currencies are shown in the Services. Before completing a purchase, customers will be shown the price and any fees or taxes we are required to collect. Currency conversion or payment-provider fees may apply.

By providing a payment method, you authorize OpenCreators and its payment providers to charge the displayed amount and to process related refunds, reversals, or adjustments. You represent that you are authorized to use the payment method. A payment may be declined, delayed, canceled, or reviewed to prevent fraud, comply with law, or address a payment-provider requirement.

Applicable refund, cancellation, and dispute terms will be presented at checkout or otherwise made available before purchase. Mandatory consumer rights remain unaffected. Digital Products, Custom Offers, Gaming Affiliates transactions, and 1:1 Video Sessions may have different rules because they are fulfilled differently.

Customers should contact the creator or OpenCreators promptly if a product was not delivered, was materially different from its description, or involved an unauthorized transaction. Repeated, abusive, or fraudulent chargebacks may result in account restrictions.

## 7. Creator Fees, Earnings, Wallets, and Payouts

We may charge creators platform, transaction, payment-processing, currency-conversion, withdrawal, or other fees. Applicable fees will be disclosed before a creator publishes an offer, completes a relevant action, or requests a payout.

Amounts displayed in a wallet or earnings dashboard may be pending, estimated, or subject to adjustment. They are not a bank deposit and do not earn interest unless applicable law requires otherwise.

We or our payout providers may:

- require identity, tax, bank-account, or business verification;
- apply payout schedules, minimum thresholds, supported currencies, or geographic restrictions;
- delay, withhold, reverse, offset, or reserve amounts reasonably needed to address refunds, chargebacks, fraud, legal obligations, negative balances, or violations of these Terms; and
- report or withhold taxes where legally required.

Creators are responsible for determining, reporting, and paying taxes arising from their sales and earnings, except for taxes OpenCreators is legally required to collect, withhold, or remit.

## 8. User Content and Licenses

"User Content" means content that a user submits, uploads, publishes, generates, sends, or makes available through the Services, including profile information, storefront content, product files, messages, recommendations, reviews, images, audio, video, links, and AI inputs or outputs selected for use.

You retain ownership of your User Content. You grant OpenCreators a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, format, adapt for te
chnical purposes, transmit, display, distribute, and otherwise process your User Content only as reasonably necessary to:

- operate, secure, and improve the Services;
- publish content you choose to make public;
- deliver products, messages, and sessions to intended recipients;
- create previews, thumbnails, formatting, and accessibility features;
- provide requested AI-assisted features; and
- comply with law and enforce these Terms.

This license lasts for as long as necessary to provide the relevant Services and then for a reasonable period for backups, legal compliance, disputes, or other purposes described in our Privacy Policy. Public content copied or shared by others may remain outside our control after deletion.

You represent that you own or have all rights necessary for your User Content and that our permitted use of it will not violate any law, agreement, privacy right, publicity right, intellectual-property right, or other third-party right.

We may remove, restrict, or disable User Content that we reasonably believe violates these Terms, applicable law, or another person's rights.

## 9. AI-Assisted Features

The Services may use artificial intelligence to analyze authorized information and generate suggestions for creator positioning, biographies, storefront designs, product ideas, descriptions, recommendations, and other content.

AI output may be inaccurate, incomplete, unsuitable, or similar to content generated for others. You must review output before using or publishing it and remain responsible for your decisions, claims, products, and User Content. OpenCreators does not guarantee that AI output is unique, correct, non-infringing, or fit for a particular purpose.

You may not use AI-assisted features to generate or distribute unlawful, deceptive, infringing, harmful, or prohibited content; make decisions about another person where prohibited by law; or misrepresent AI output as verified professional advice.

The Privacy Policy explains how AI inputs and outputs are processed.

## 10. Acceptable Use

You may not use the Services to:

- violate law, sanctions, platform rules, or third-party rights;
- sell, request, promote, or distribute illegal, stolen, counterfeit, infringing, deceptive, dangerous, or otherwise prohibited products or services;
- exploit, sexualize, endanger, or facilitate harm to children or young people;
- threaten, harass, stalk, defame, discriminate against, or incite violence toward another person;
- publish non-consensual intimate content or content that unlawfully invades privacy or publicity rights;
- impersonate another person or organization, misrepresent affiliation, manipulate reviews or metrics, or make false commercial claims;
- send spam, phishing, malware, or unauthorized advertising;
- commit fraud, launder money, evade taxes, manipulate affiliate attribution, or abuse payments, refunds, promotions, wallets, or payouts;
- collect, scrape, or use personal information without authorization or a lawful basis;
- gain unauthorized access to accounts, systems, data, or security controls;
- interfere with the operation or integrity of the Services;
- reverse engineer, decompile, or attempt to extract source code, models, prompts, or non-public data, except where law expressly permits it;
- use automated means to access the Services except through an interface or API we authorize; or
- help another person do any of the above.

We may investigate suspected violations and cooperate with payment providers, platform partners, rights holders, and authorities where appropriate. Additional restricted-product or community rules presented through the Services may also apply.

## 11. Intellectual Property

The Services—including our software, interfaces, designs, logos, trademarks, documentation, and other materials provided by OpenCreators—are owned by OpenCreators or its licensors and are protected by intellectual-property laws. Except for the limited right to use the Services under these Terms, no rights are granted to you.

"OpenCreators" and associated names, logos, and branding may not be used without our prior written permission. Third-party names and trademarks belong to their respective owners.

If you provide feedback, ideas, or suggestions, you grant us a perpetual, irrevocable, worldwide, royalty-free right to use them without restriction or compensation, provided we do not publicly identify you as the source without permission.

If you believe content on the Services infringes your intellectual-property rights, contact [email protected] with enough information for us to identify the work, the allegedly infringing material, your contact details, and the basis for your claim. We may request additional information and may suspend repeat infringers where appropriate.

## 12. Connected Platforms and Third-Party Services

The Services may link to or integrate with third parties, including Google, Apple, TikTok, Instagram, YouTube, payment and payout providers, game partners, video providers, and creator websites. Your use of a third-party service is governed by that party's terms and privacy policy. OpenCreators does not control and is not responsible for an independent third-party service.

If you connect an account, you authorize us to access and use information within the permissions shown to you. You represent that you are entitled to connect the account and use the associated content. You must comply with the connected platform's rules.

You may disconnect a supported integration through OpenCreators settings, where available, and may also revoke access through the third-party platform. Revoking access may disable related OpenCreators features and does not automatically delete information that must be retained for transactions, security, disputes, or legal compliance.

### TikTok Login and Permissions

When TikTok Login Kit is enabled, selecting **Continue with TikTok** redirects you to TikTok's authorization flow. TikTok shows the permissions requested, and
you choose whether to authorize them. After authorization, TikTok redirects you to OpenCreators, and our server exchanges the authorization code for tokens needed to provide the approved connection.

Depending on the permissions you approve, we may receive a TikTok account identifier and basic profile information such as your display name and avatar. If OpenCreators requests additional information—such as public video or profile data—we will request only the scopes needed for the disclosed feature and use the information to provide features such as account recognition, creator-profile analysis, and storefront setup.

We will not use a TikTok permission to post or share content unless that capability is enabled, the relevant permission is shown, and you initiate or clearly authorize the action. Any future TikTok capability will be subject to the permissions and disclosures shown at that time.

You can unlink TikTok through available OpenCreators account settings and revoke authorization through TikTok. Our handling of identifiers, tokens, connected-profile information, and deletion requests is described in the Privacy Policy.

## 13. Privacy and Customer Information

Our Privacy Policy, available at https://opencreators.ai/privacy, explains how OpenCreators collects, uses, discloses, and protects personal information.

Creators may receive customer information needed to fulfill a transaction, such as names, contact details, requirements, messages, and booking information. A creator may use that information only to fulfill the transaction, provide support, comply with law, or for another purpose supported by a valid legal basis and appropriate notice. Creators may not sell customer information, add customers to marketing lists without required permission, or use information for unrelated purposes.

If a creator independently determines how and why to process customer information outside the Services, the creator is responsible for meeting any obligations that apply to them as a controller, business, or similar regulated party.

## 14. Service Availability and Changes

We may add, change, suspend, or discontinue a feature or part of the Services. Where reasonably possible, we will provide notice if a material change adversely affects active paid features or access to purchased content.

The Services may be unavailable because of maintenance, technical problems, third-party failures, security incidents, legal requirements, or events outside our reasonable control. We do not guarantee uninterrupted or error-free operation.

Features identified as beta, preview, experimental, or similar are provided for evaluation, may change without notice, and may be less reliable than generally available features.

## 15. Suspension and Termination

You may stop using the Services at any time and may request account deletion through available account settings or by contacting [email protected], subject to transaction, payout, dispute, security, and legal-retention requirements.

We may restrict, suspend, or terminate access; hold or reverse eligible funds; remove content; or take other reasonable action if:

- you violate these Terms or applicable law;
- your activity creates fraud, payment, security, safety, legal, or reputational risk;
- a platform, payment provider, or authority requires action;
- required verification is incomplete or inaccurate;
- fees or balances remain unpaid; or
- continuing to provide the Services is no longer commercially or technically feasible.

Where appropriate and permitted, we will provide notice and an opportunity to appeal or correct the issue. We may act immediately where necessary to protect users, prevent harm, secure the Services, or comply with law.

After termination, rights and obligations that by their nature should continue will survive, including provisions concerning ownership, content licenses needed for retained records, payments, taxes, disclaimers, liability, indemnity, disputes, and enforcement.

## 16. Disclaimers

Nothing in these Terms excludes warranties, guarantees, or rights that cannot lawfully be excluded.

To the fullest extent permitted by law, the Services are provided "as is" and "as available." OpenCreators and its affiliates, officers, employees, agents, licensors, and service providers disclaim all express, implied, and statutory warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and course of dealing.

We do not warrant that the Services, AI output, creator products, customer conduct, earnings estimates, affiliate commissions, third-party services, or any content will be uninterrupted, secure, accurate, complete, lawful, suitable, or free from harmful components. You use the Services and transact with other users at your own risk, subject to rights that cannot be waived.

## 17. Limitation of Liability

Nothing in these Terms limits liability that cannot lawfully be limited, including liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence where applicable law prohibits limitation.

To the fullest extent permitted by law, OpenCreators and its affiliates, officers, employees, agents, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, business opportunities, or anticipated savings, arising out of or related to the Services or these Terms, even if advised that such damages were possible.

To the fullest extent permitted by law, the total aggregate liability of OpenCreators and the parties listed above for all claims arising out of or related to the Services or these Terms will not exceed the amounts you paid to OpenCreators in the 12 months preceding the event giving rise to the claim.

The limitations in this section apply only to the extent enforceable in your jurisdiction. Some jurisdictions do not allow certain exclusions or limitations, so some of them may not apply to you.

## 18. Indemnity

To the fullest extent permitted by law, if you use the Services for business or creator-commerce purposes, you will defend, indemnify, and hold harmless OpenCreators and its affiliates, officers, employees, agents, licensors, and service providers from third-party claims, losses, liabilities, damages, judgments, penalties, costs, and reasonable legal fees arising from:

- your User Content, products, services, claims, or fulfillment;
- your breach of these Terms;
- your violation of law or another person's rights;
- taxes, refunds, chargebacks, or customer disputes for which you are responsible; or
- your misuse of the Services.

This obligation does not apply to the extent a claim results from OpenCreators' own breach, negligence, or willful misconduct, and it does not limit non-waivable consumer rights.

## 19. Governing Law and Disputes

Before filing a formal claim, you and OpenCreators agree to make a good-faith effort to resolve the dispute informally. Send a written notice describing the dispute and requested resolution to [email protected]. We will attempt to respond within 30 days.

These Terms and any non-contractual dispute arising from them are governed by the laws of the Hong Kong Special Administrative Region, without regard to conflict-of-laws principles. Subject to any mandatory rights available to consumers, the courts of the Hong Kong Special Administrative Region will have exclusive jurisdiction.

If you are a consumer, this section does not deprive you of protections or a forum that cannot be waived under the laws of your place of residence.

## 20. Changes to These Terms

We may update these Terms to reflect changes to the Services, our business, or applicable law. We will update the "Last updated" date and provide additional notice of material changes where required.

Changes apply from the effective date stated in the notice. If applicable law requires consent to a material change, we will request it. Otherwise, continued use after the effective date constitutes acceptance of the updated Terms. Changes will not retroactively alter a completed transaction unless required by law or agreed by the affected parties.

## 21. General Terms

- **Entire agreement:** These Terms and incorporated policies form the entire agreement between you and OpenCreators regarding the Services, except for additional written terms that expressly apply.
- **No waiver:** Failure to enforce a provision is not a waiver of the right to enforce it later.
- **Severability:** If a provision is held unenforceable, it will be modified to the minimum extent necessary or removed, and the remaining provisions will continue in effect.
- **Assignment:** You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, reorganization, sale of assets, or by operation of law, subject to applicable law.
- **No third-party beneficiaries:** These Terms do not create rights for anyone other than you and OpenCreators, except where expressly stated.
- **Electronic communications:** You agree to receive agreements, notices, receipts, and other communications electronically where permitted by law.
- **Language:** These Terms are written in English. Any translation is provided for convenience, and the English version controls to the extent permitted by law.
