190

191
These Terms are the agreement between you and Stitchbird. They explain what Stitchbird does, the subscription terms, what you're responsible for, and the limits on our liability. Please read them — by using Stitchbird, you agree to them.

192

193
194
These Terms of Service ("Terms") govern your use of Stitchbird (the "Service"), operated by Andrew Marco, a sole proprietor doing business as Stitchbird ("Stitchbird," "we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

195
196
1. What Stitchbird Is

197
Stitchbird is a tool for Etsy sellers that turns your Etsy orders into production checklists. It consists of a Chrome browser extension and a companion web application. The extension reads the order information displayed on your own Etsy orders page when you click Sync, and organizes it into production checklists you can work from and check off.

198
Stitchbird is an independent application and is not affiliated with, endorsed by, or sponsored by Etsy, Inc. "Etsy" is a registered trademark of Etsy, Inc. You are responsible for using Stitchbird in compliance with Etsy's own Terms of Service.

199
200
2. How Stitchbird Accesses Your Order Data

201
Stitchbird does not connect to Etsy's API and does not log into your Etsy account or access your Etsy credentials. The extension reads the order information already visible on your own Etsy orders page in y
201our browser, only when you click Sync, and only on Etsy pages. You remain logged into Etsy yourself; Stitchbird simply reads what is already on your screen.

202
You are responsible for ensuring your use of Stitchbird complies with Etsy's Terms of Service. Etsy may change its website at any time, which may affect how, or whether, Stitchbird can read your orders. We do not guarantee uninterrupted compatibility with Etsy.

203
204
3. Your Account

205
To use Stitchbird you must create a Stitchbird account using a valid email address. You are responsible for maintaining access to the email account you sign up with, since sign-in uses an emailed magic link. You are responsible for all activity under your account. One account is intended for one Etsy shop; if you operate multiple shops, each requires its own account and subscription.

206
207
4. Subscription, Trial, and Billing

208
Stitchbird is a paid subscription service offered on monthly and annual plans. The current prices are shown at checkout.

209

210
Free trial: New users receive a 14-day free trial. A valid payment method is required to start the trial. You will not be charged during the trial.

211
Automatic conversion: Unless you cancel before the trial ends, your subscription automatically begins and your payment method is charged at the end of the trial, and then at the start of each billing period thereafter.

212
Cancellation: You may cancel at any time from the Settings panel in the app. Cancellation stops future billing — your subscription remains active until the end of the period you have already paid for, and is not renewed after that.

213
No refunds: Payments are non-refundable. We do not provide refunds or credits for partial billing periods, unused time, or periods during which you did not use the Service. The free trial exists so you can evaluate Stitchbird before being charged. This does not affect any rights you cannot waive under applicable law.

214
Price changes: We may change subscription prices. We will give existing subscribers notice before a price change affects them, and you may cancel if you do not accept the new price.

215

216
217
5. Account Deletion

218
You may delete your account at any time from the Settings panel in the app. Deletion is immediate and permanent: it cancels your subscription immediately (you forfeit any remaining paid time), and deletes your server-stored data as described in our Privacy Policy. This action cannot be undone.

219
220
6. Acceptable Use

221
You agree not to:

222

223
Use the Service in any way that violates Etsy's Terms of Service or applicable law

224
Use Stitchbird to process data for any Etsy shop that is not your own

225
Attempt to gain unauthorized access to the Service, other users' data, or our underlying systems

226
Resell, sublicense, share, or redistribute access to the Service without our prior written permission

227
Reverse engineer, decompile, or attempt to extract the source code of the Service, except where that restriction is prohibited by law

228
Interfere with, disrupt, or place an unreasonable load on the Service or its infrastructure

229

230
We may suspend or terminate your access if you violate these Terms or use the Service in a way that harms Stitchbird, other users, or third parties.

231
232
7. Your Data and Buyer Information

233
Your shop data — including your orders and the production checklists derived from them — remains yours. Stitchbird claims no ownership of your shop data. How we store and handle it, including buyer information, is described in our Privacy Policy, which forms part of these Terms.

234
You are responsible for handling your buyers' information lawfully, including any obligations you have to your buyers under Etsy's policies and applicable privacy laws. Stitchbird processes this information solely to provide the Service to you.

235
236
8. ShopIQ and AI Features

237
Stitchbird uses artificial intelligence (Claude, by Anthropic) to help interpret the personalization text buyers leave on orders and turn it into production rows. AI interpretation is a convenience and may contain errors. Etsy remains the source of truth for your orders. You are solely responsible for verifying your production against the actual order details on Etsy before making or shipping any item. Stitchbird is not responsible for errors in AI interpretation or for any production mistakes resulting from reliance on it.

238
239
9. Disclaimer of Warranties

240
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

241
Stitchbird does not warrant that the Service will be uninterrupted, error-free, secure, or continuously compatible with Etsy. Stitchbird helps you organize your production but does not guarantee the accuracy of any parsed order, checklist, or grouping. You are responsible for verifying all order details against Etsy before producing or shipping.

242
243
10. Limitation of Liability

244
To the maximum extent permitted by applicable law, Stitchbird and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost sales, lost or mis-produced orders, lost data, or business interruption, arising from or related to your use of or inability to use the Service, even if advised of the possibility of such damages.

245
To the maximum extent permitted by applicable law, Stitchbird's total liability for any claim arising from or related to the Service shall not exceed the amount you paid to Stitchbird in the twelve (12) months preceding the event giving rise to the claim.

246
247
11. Indemnification

248
You agree to indemnify and hold harmless Stitchbird and its operator from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, your handling of buyer information, or your violation of Etsy's terms or any third party's rights.

249
250
12. Termination

251
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, fail to pay, or use the Service in a way that creates risk or harm. On termination, your right to use the Service ends; the sections of these Terms that by their nature should survive (including Disclaimers, Limitation of Liability, and Indemnification) will survive.

252
253
13. Governing Law

254
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. You agree that any dispute arising from these Terms or the Service will first be addressed through good-faith negotiation, and if unresolved, will be subject to the exclusive jurisdiction of the state and federal courts located in California.

255
256
14. Changes to These Terms

257
We may update these Terms as the Service evolves or as required by law. When we make material changes, we will update the "Last updated" date and notify you by email or an in-app notice at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
