OBJETO</p><p style="line-height: 18px;">Estes Termos de Uso regulam a utilização da plataforma <strong style="">AppDaqui</strong>, compreendendo o aplicativo licenciado, painel administrativo, site, APIs, integrações e demais recursos fornecidos pela <strong style="">APPDAQUI APLICATIVO LTDA</strong> (“LICENCIANTE”), bem como a relação entre a LICENCIANTE e o cliente licenciado (“LICENCIADO”).</p><p style="line-height: 18px;">O uso da plataforma implica a <strong style="">aceitação integral e irrevogável</strong> destes Termos.</p><p style="font-size: 14px; line-height: 21px; text-align: left;"><br style="">2. LICENÇA DE USO</p><p style="line-height: 18px;">2.1 – O LICENCIADO recebe uma <strong style="">licença de uso anual</strong> do aplicativo e demais recursos da plataforma, de caráter <strong style="">não exclusivo</strong>, podendo transferi-la a terceiros apenas mediante <strong style="">anuência prévia e expressa da LICENCIANTE</strong>.</p><p style="line-height: 18px;">2.2 – A licença é válida enquanto o LICENCIADO mantiver a assinatura ativa e adimplente, conforme o contrato de licenciamento firmado entre as partes.</p><p style="line-height: 18px;">2.3 – A licença não confere ao LICENCIADO qualquer direito sobre o <strong style="">código-fonte, design, marca ou demais elementos de propriedade intelectual</strong> da LICENCIANTE.</p><p style="font-size: 14px; line-height: 21px; text-align: left;"><br style="">3. RESPONSABILIDADE PELO CONTEÚDO</p><p style="line-height: 18px;">3.1 – Todo conteúdo inserido no aplicativo, incluindo textos, imagens, vídeos, anúncios e dados, é de <strong style="">responsabilidade exclusiva do LICENCIADO</strong>.</p><p style="line-height: 18px;">3.2 – O LICENCIADO declara estar ciente de que é proibida a utilização da plataforma para fins ilícitos, ofensivos ou que violem direitos de terceiros, incluindo direitos autorais e de imagem.</p><p style="font-size: 14px; line-height: 21px; text-align: left;"><br style="">4. SUPORTE TÉCNICO</p><p style="line-height: 18px;">4.1 – O LICENCIADO terá direito a <strong style="">suporte técnico básico e gratuito</strong> durante o período de vigência da licença, prestado exclusivamente por meio online.</p><p style="line-height: 18px;">4.2 – O suporte é limitado à solução de questões relacionadas ao uso dos recursos da plataforma e não inclui produção de conteúdo, administração do aplicativo ou desenvolvimento de funcionalidades fora do escopo contratado.</p><p style="font-size: 14px; line-height: 21px; text-align: left;"><br style="">5. SERVIÇOS DE TERCEIROS</p><p style="line-height: 18px;">5.1 – A publicação, funcionamento e manutenção do aplicativo podem depender de <strong style="">serviços de terceiros</strong>, como <strong style="">Google Play, App Store, hospedagem, gateways de pagamento e outros</strong>.</p><p style="line-height: 18px;">5.2 – O LICENCIADO reconhece que tais serviços possuem <strong style="">termos de uso e políticas próprias</strong>, às quais também estará vinculado, e que a LICENCIANTE <strong style="">não possui controle</strong> sobre seu funcionamento, prazos, aprovações ou mudanças de regras.</p><p style="font-size: 14px; line-height: 21px; text-align: left;"><br style="">6. PERSONALIZAÇÃO E DIREITO DE ARREPENDIMENTO</p><p style="line-height: 18px;">6.1 – O aplicativo fornecido pela LICENCIANTE é <strong style="">personalizado e desenvolvido sob encomenda</strong>, com início imediato da configuração e personalização após a assinatura do contrato.</p><p style="line-height: 18px;">6.2 – Por se tratar de produto personalizado, não se aplica o direito de arrependimento previsto no art. 49 do Código de Defesa do Consumidor.</p><p style="font-size: 14px; line-height: 21px; text-align: left;"><br style="">7. PRIVACIDADE</p><p style="line-height: 18px;">7.1 – A LICENCIANTE poderá coletar e armazenar dados necessários para o funcionamento da plataforma.</p><p style="line-height: 18px;">7.2 – Os dados não serão vendidos ou compartilhados com terceiros para fins comerciais, exceto quando exigido por lei ou para o funcionamento dos serviços contratados.</p><p style="font-size: 14px; line-height: 21px; text-align: left;"><br style="">8. VIGÊNCIA E ALTERAÇÕES</p><p style="line-height: 18px;">8.1 – Estes Termos permanecem válidos enquanto o LICENCIADO utilizar a plataforma.</p><p style="line-height: 18px;">8.2 – A LICENCIANTE poderá atualizar estes Termos de Uso a qualquer momento, notificando o LICENCIADO por e-mail ou por aviso dentro da plataforma.</p><p style="font-size: 14px; line-height: 21px; text-align: left;"><br style="">9.
