By creating an organization account, you represent that your organization, and each end client for which you use the Services, is not established in any of those jurisdictions. If you enroll monitored users who are located in those jurisdictions, you are responsible for providing any notices, and satisfying any other requirements, that applicable law imposes on that monitoring. Analysis runs may be submitted only from jurisdictions in which Blue Lantern makes that functionality available, currently the Americas, Australia, New Zealand, and South Africa, and the Services may not be accessed from sanctioned or other restricted jurisdictions. Users outside those jurisdictions may be permitted to create accounts and access account-management pages where not prohibited by law or by Blue Lantern’s access controls. If Blue Lantern closes your organization account or these Terms terminate, and you submit a written request within fifteen (15) days after that closure or termination, Blue Lantern will make Customer Data and reports then held by Blue Lantern available for export through the Services or API for a reasonable period not to exceed thirty (30) days following such request, after which Blue Lantern may delete such materials in accordance with its ordinary retention schedule. Blue Lantern has no obligation to restore, recreate, retain, or export submitted inputs, reports, or other materials that were deleted, anonymized, or aggregated in accordance with Blue Lantern’s ordinary retention schedule before the export request was received. If no such request is received, Blue Lantern may delete Customer Data and reports after that closure or termination in accordance with its ordinary retention schedule. Upon the effective date of termination or expiration, your right to access and use paid Services will cease, and you must discontinue all unauthorized use of the Services and delete all Blue Lantern installed software, credentials, activation artifacts, and other proprietary artifacts from your systems unless Blue Lantern authorizes continued Free Tier access. Termination will not relieve either party of obligations that accrued prior to the effective date of termination, including any payment obligations. The remedies in the preceding sentence are your sole and exclusive remedies for any claim that the Services infringe third-party intellectual property rights. You will defend, indemnify, and hold harmless Blue Lantern from third-party claims, including claims by your personnel, end clients, or other monitored individuals, arising from your misuse of the Services, lack of authorization to submit Customer Data or test targets, connect accounts or systems, or monitor users or devices, failure to provide notices or obtain consents that applicable law requires for your monitoring, or violation of law or these Terms."}),e.jsx("p",{children:"These Terms are governed by the laws of the State of Colorado, excluding conflict-of-law rules.
