This general 949 data and information are stored in the server log files. 950 Collected may be (1) the browser types and versions used, (2) 951 the operating system used by the accessing system, (3) the 952 website from which an accessing system reaches our website 953 (so-called referrers), (4) the sub-websites, (5) the date and 954 time of access to the Internet site, (6) an Internet protocol 955 address (IP address), (7) the Internet service provider of the 956 accessing system, and (8) any other similar data and 957 information that may be used in the event of attacks on our 958 information technology systems. When using these general data 959 and information, the Meetecho SRL does not draw any conclusions 960 about the data subject. Rather, this information is needed to 961 (1) deliver the content of our website correctly, (2) optimize 962 the content of our website as well as its advertisement, (3) 963 ensure the long-term viability of our information technology 964 systems and website technology, and (4) provide law enforcement 965 authorities with the information necessary for criminal 966 prosecution in case of a cyber-attack. Therefore, the Meetecho 967 SRL analyzes anonymously collected data and information 968 statistically, with the aim of increasing the data protection 969 and data security of our enterprise, and to ensure an optimal 970 level of protection for the personal data we process. The 971 anonymous data of the server log files are stored separately 972 from all personal data provided by a data subject.
973 974
5. Contact possibility via the website
975
The website of the Meetecho SRL 976 contains information that enables a quick electronic contact to 977 our enterprise, as well as direct communication with us, which 978 also includes a general address of the so-called electronic 979 mail (e-mail address). If a data subject contacts the 980 controller by e-mail or via a contact form, the personal data 981 transmitted by the data subject are automatically stored. Such 982 personal data transmitted on a voluntary basis by a data 983 subject to the data controller are stored for the purpose of 984 processing or contacting the data subject. Comments function in the blog on the website
988
The Meetecho SRL offers users the 989 possibility to leave individual comments on individual blog 990 contributions on a blog, which is on the website of the 991 controller. A blog is a web-based, publicly-accessible portal, 992 through which one or more people called bloggers or 993 web-bloggers may post articles or write down thoughts in 994 so-called blogposts. Blogposts may usually be commented by 995 third parties. If a data subject leaves a comment on the blog 996 published on this website, the comments made by the data 997 subject are also stored and published, as well as information 998 on the date of the commentary and on the user's (pseudonym) 999 chosen by the data subject. In addition, the IP address 1000 assigned by the Internet service provider (ISP) to the data 1001 subject is also logged. This storage of the IP address takes 1002 place for security reasons, and in case the data subject 1003 violates the rights of third parties, or posts illegal content 1004 through a given comment. The storage of these personal data is, 1005 therefore, in the own interest of the data controller, so that 1006 he can exculpate in the event of an infringement. This 1007 collected personal data will not be passed to third parties, 1008 unless such a transfer is required by law or serves the aim of 1009 the defense of the data controller.
1010 1011
7. In 1014 particular, there is the possibility that a commenter 1015 subscribes to the comments following his comments on a 1016 particular blog post. If a data subject decides to subscribe to 1017 the option, the controller will send an automatic confirmation 1018 e-mail to check the double opt-in procedure as to whether the 1019 owner of the specified e-mail address decided in favor of this 1020 option. The option to subscribe to comments may be terminated 1021 at any time. 1022 1023
1024
8. Routine erasure and blocking of personal datae
1025
The data controller shall process 1026 and store the personal data of the data subject only for the 1027 period necessary to achieve the purpose of storage, or as far 1028 as this is granted by the European legislator or other 1029 legislators in laws or regulations to which the controller is 1030 subject to. If the storage purpose is not applicable, or if a 1031 storage period prescribed by the European legislator or another 1032 competent legislator expires, the personal data are routinely 1033 blocked or erased in accordance with legal requirements.
1034 1035 1036
9. Legal basis for the processing
1347
Art. 6(1) lit. a GDPR serves as 1348 the legal basis for processing operations for which we obtain 1349 consent for a specific processing purpose. If the processing of 1350 personal data is necessary for the performance of a contract to 1351 which the data subject is party, as is the case, for example, 1352 when processing operations are necessary for the supply of 1353 goods or to provide any other service, the processing is based 1354 on Article 6(1) lit. b GDPR. The same applies to such 1355 processing operations which are necessary for carrying out 1356 pre-contractual measures, for example in the case of inquiries 1357 concerning our products or services. Is our company subject to 1358 a legal obligation by which processing of personal data is 1359 required, such as for the fulfillment of tax obligations, the 1360 processing is based on Art. 6(1) lit. c GDPR. In rare cases, 1361 the processing of personal data may be necessary to protect the 1362 vital interests of the data subject or of another natural 1363 person. This would be the case, for example, if a visitor were 1364 injured in our company and his name, age, health insurance data 1365 or other vital information would have to be passed on to a 1366 doctor, hospital or other third party. Then the processing 1367 would be based on Art. 6(1) lit. d GDPR. Finally, processing 1368 operations could be based on Article 6(1) lit. f GDPR. This 1369 legal basis is used for processing operations which are not 1370 covered by any of the abovementioned legal grounds, if 1371 processing is necessary for the purposes of the legitimate 1372 interests pursued by our company or by a third party, except 1373 where such interests are overridden by the interests or 1374 fundamental rights and freedoms of the data subject which 1375 r
1375equire protection of personal data. Such processing operations 1376 are particularly permissible because they have been 1377 specifically mentioned by the European legislator. He 1378 considered that a legitimate interest could be assumed if the 1379 data subject is a client of the controller (Recital 47 Sentence 1380 2 GDPR).
1381
11. The legitimate interests pursued by the controller 1382 or by a third party
1383
Where the processing of personal 1384 data is based on Article 6(1) lit. f GDPR our legitimate 1385 interest is to carry out our business in favor of the 1386 well-being of all our employees and the shareholders.
1387 1388
12. Period for which the personal data will be stored
1389
The criteria used to determine 1390 the period of storage of personal data is the respective 1391 statutory retention period. After expiration of that period, 1392 the corresponding data is routinely deleted, as long as it is 1393 no longer necessary for the fulfillment of the contract or the 1394 initiation of a contract.
1395
13. Sometimes it may be 1404 necessary to conclude a contract that the data subject provides 1405 us with personal data, which must subsequently be processed by 1406 us. The data subject is, for example, obliged to provide us 1407 with personal data when our company signs a contract with him
1408 or her. The non-provision of the personal data would have the 1409 consequence that the contract with the data subject could not 1410 be concluded. Before personal data is provided by the data 1411 subject, the data subject must contact any employee. The 1412 employee clarifies to the data subject whether the provision of 1413 the personal data is required by law or contract or is 1414 necessary for the conclusion of the contract, whether there is 1415 an obligation to provide the personal data and the consequences 1416 of non-provision of the personal data.
1417
14.
